| 24 | Regular maintenance for three years (including free maintenance for 1 year) of all the newly installed children play equipment at said location in DDA park as per schedule A consists of the following :-a) Replacement/repair of parts of equipment in case of theft/ vandalism.b) Check and set right/replacement for worn bearings, misaligned moving points, adjust/tighten loose parts, covers, seats, foundation and flooring.c) Tightening nuts/bolts/screws i/c welding of various parts/joints of equipment wherever required.d) Calibration of Instrument every three months.e) Priming coat & painting coat, if required.f) Lubrication/oiling every 15 days.g) Inspect and adjustment of drive, timing and running belts.h) Replacement of damaged parts & rectification of any other defects observed as per the direction of the Engineer-in-charge except : i. Due to Force majeure or ii. Abnormally bad weather, serious loss or damage by fire or iii. Damage due to the act of god or iv. Any other cause which is in the absolute discretion of the Engineer-in-charge is beyond the contractor's control.Terms & Conditions:1. The agency shall regularly inspect & upkeep the equipment in working condition as required at all times during the contract period.2. The complaint as and when it occurred shall be attended to within 3 days during 3 years maintenance period, failing which a penalty of @ Rs. 2,000.00 per day shall be imposed and shall be recovered.3. If the equipment (or its parts) is stolen due to negligence in maintenance by the agency, the agency must replace the stolen equipment/parts. No payment will be made to the agency for this replacement (i.e., the agency bears the full cost of replacement).4. The performance guarantee(s) submitted by the agency shall be released after recording of final completion certificate (i.e. after completion of 3-year maintenance period).5. The provisional completion shall be recorded by the competent authority separately for the installation of children play equipment. However, the final completion certificate shall be recorded by the competent authority after successful completion of 3-year maintenance period.6. The security deposit withheld @2.5% of the gross amount of each Running Account (R/A) Bill/ Final Bill till the sum deducted will amount to security deposit of 2.5% of the tendered amount of the work shall be released after recording of final completion certificate by the Competent Authority (i.e. after completion of 3-year maintenance period).7. An additional amount equal to 40% of the installation cost of equipment (i.e. new equipment from S.No. 10 to 18 of schedule-A) shall be withheld apart from security deposit from each Running Account (R/A) bill, against warranty. This amount shall be proportionately released year wise after successful completion of each year of the 3-year maintenance period (including both the free and paid maintenance periods).
