The bidder shall ensure that while filling the Price Bid, the following details are mandatorily indicated without fail: (a) The Service Accounting Code (SAC) relevant to the services being quoted, (b) The applicable rate of Goods and Services Tax (GST) on the basic quoted rates, and(c) The percentage rate quoted by the bidder, clearly specifying whether the same is to be considered as Excess (+), Below (–), or At Par in relation to the basic estimated rate of ONGC.2. The bidders are required to note that the evaluation of their offer shall be undertaken strictly by working out the prices on the basis of the percentage rate quoted by them (whether Excess (+), Below (–), or At Par) over the ONGC estimated base price, along with the applicable GST tariff as quoted by them. The applicable GST rate on the basic rate is to be quoted mandatorily and shall be utilized not only for the purpose of evaluation but also for the purpose of regulating any adjustment arising out of a “Change in Law” during the entire course of execution of the contract.3. Bidder must fill only one percentage rate in any one column from the three columns given in above table. Bidders filling their percentage rate in more than one column shall be rejected straightway.4. In the event that a bidder fails to fill any of the options in percentage rate (Excess (+), Below (–), or At Par), it shall be deemed that the bidder has provided his unconditional consent to carry out the work at ONGC’s estimated rate put to tender, i.e., At Par.5. The ranking of the bidders shall be determined by calculating the evaluated price on the basis of the percentage rate quoted (Excess (+), Below (–), or At Par) over ONGC’s estimated base rate together with the GST tariff quoted by the bidder. 6. It is mandatory for the bidder to indicate the applicable GST rate on the basic quoted rate. In the event that a bidder fails to mention the applicable GST rate, it shall be deemed for the purpose of evaluation and contract execution that the bidder has considered the GST rate to be eighteen percent (18%).7. The percentage rate quoted by the bidder shall be deemed to be inclusive of all applicable taxes, duties, levies, and statutory charges payable under law and no additional payment whatsoever shall be admissible to the bidder on this account beyond the quoted rate.8. The price quoted by the bidder shall be deemed to be inclusive of all charges towards transportation of personnel, materials, consumables, equipment, or any other item required for execution of the work, and no additional amount shall be admissible to the bidder on this account.9. The successful bidder shall be required to attend to and execute the works promptly and fully in accordance with the complete scope of work stipulated in the tender documents, without claiming or being entitled to any extra cost or additional payment from ONGC beyond the quoted rates.10. The Goods and Services Tax (GST) and Customs Duty, if any, applicable on input services, capital goods, and other inputs required for execution of the scope of work, shall be fully borne by the bidder within the percentage rate quoted by him in the BOQ. The bidder shall mandatorily avail all eligible Input Tax Credit (ITC) of GST and Customs Duty paid on such input services, capital goods, and inputs. The benefit of such input tax credit shall necessarily be passed on to ONGC by way of quoting the percentage rate net of input tax credit, that is, the value of goods and/or services adjusted by the amount of input tax credit available to the bidder. No separate reimbursement on this account shall be admissible by ONGC under any circumstances.11. Bidders are required to ascertain themselves, the prevailing rates of goods & service tax and all other taxes and duties as applicable (along with rates of all related levies viz. Surcharges, Cess, etc.,) on the scheduled date of submission of Price Bids/ revised Price Bids (if any) and ONGC would not undertake any responsibility whatsoever in this regard.12. Based on the total amount quoted by the successful bidder above or below the estimate, item wise rate indicated below (Annexure-III-A & Annexure-III-B) will be adjusted upwards or downwards in the same ratio. These rates will be frozen for the contract period and executed quantities during any period will be payable on the basis of these frozen rates.13. The bidder shall indicate details/break up of taxes (GST) included in their quote for consideration under „Change in Law‟ provisions of the contract in this format. In case, the quoted information related to various taxes and duties subsequently proves wrong, incorrect or misleading: -a) ONGC will have no liability to reimburse the difference in the duty/tax, if the finally assessed amount is on the higher side.b) ONGC will have the right to award the contract with applicable rate of duty /tax or recover the difference, in case the rate of duty / tax finally assessed is on the lower side. DECLARATION BY BIDDER (1) I/We have understood the scope and specifications of the work.(2) My/our above quoted %age is inclusive of all taxes and duties and nothing extra on this account shall be admissible to us. (3) My/our quoted price is inclusive of all transportation charges of the personnel and the material and nothing extra on this account shall be admissible to us.(4) I/we shall attend to the works promptly as per the scope of work without extra cost to ONGC.(5) Bidder to note that the bid will be evaluated on gross total amount quoted by bidder. |
