| 5 | The rates and prices to be tendered in the unit Priced Bill of Quantities are for completed and finished items of works and complete in all respect. It will be deemed to include Duties, Taxes, Octroi, Royalty etc., cost of all plants, labour, supervision, materials, transport, all temporary works, erection, maintenance, utility identification, contractor’s profit and establishment/overheads, together with preparation of design and drawings, all general risks, insurance liabilities, compliance of labour laws and obligations set out or implied in the contracts. For taxes and duties refer clause C2.4 & C2.5 of ITT & clause 10 of SCC. |
| 6 | If the tenderer fails to quote rates against any item, the tender may be treated as incomplete and non-responsive and shall be rejected. |
| 7 | Errors will be corrected by the employer for any arithmetical errors in computation or summation as per contract conditions. |
| 8 | The Financial Proposal (as per BOQ) shall be uploaded online on the website http://etenders.gov.in/eprocure/app. The rates shall be quoted in the excel file provided in the bid documents. The tenderer shall download the excel file and quote the rates in BOQ1. After quoting their rates the excel file shall be uploaded accordingly. The rates shall not be offered/quoted elsewhere in the technical submission/ tender submission. |
| 9 | The actual work executed against all the BOQ as detailed in tender document would be paid as per clause-12 of ER. |
| 10 | The price offer in BOQ shall be given without considering any deviation mentioned in Appendix-13 of FOT i.e. price in this box shall be quoted as per tender condition without any deviation. |
| 11 | Bidder (whether a lighting manufacturing company (OEM) or otherwise) shall supply and install LED luminaires strictly conforming to the approved makes specified in Clause 6.1 of Appendix-C of the Employer’s Requirements, Volume-3 of the Tender Document. No deviation from the approved makes shall be permitted, and no claim or request for substitution shall be entertained on this account. |
| 12 | All necessary equipments like scaffolding/ Electric crane/Man lifter/Hydra etc. or any other special tool and equipment required to carry out the work shall have to be arranged by the bidder and the rate of any machinery/special tools etc required to carry out the work deemed to be included in the rates provided fitting wise in BOQ. |
| 13 | The Contractor has to consider all the operational constraints, block availability, deployment requirements, and logistical arrangements while quoting the rates. No additional payment or compensation on these accounts shall be admissible to the contractor. |
| 14 | Any modification to the existing cut-out, creation of a new cut-out, or covering of any vacant cut-out with aesthetically matching material is required for proper installation and finishing of the new luminaire, the same shall be deemed to be included in the scope of work and shall be carried out by the Contractor at no additional cost to DMRC |
| 15 | All the internal wiring of the fixture shall be of LSZH type, copper conductor. |
| 16 | Any additional wiring required for the successful installation and commissioning of the LED luminaires shall be deemed to be included in the scope of work. Such wiring shall be carried out using LSZH cables/wires. The Contractor shall supply, install, terminate, test and commission all such additional wiring at his own cost. No additional payment or compensation on this account shall be admissible to the Contractor. |
| 17 | Prior to commencement of manufacturing, the Contractor shall obtain approval from DMRC for the proposed CCT of each type of LED luminaire. Manufacturing of the LED luminaires shall be undertaken only after obtaining such approval from DMRC. No deviation from the approved CCT shall be permitted without the prior written approval of DMRC. The Contractor shall be deemed to have taken this requirement into account while quoting the rates, and no additional payment, compensation or any other claim whatsoever arising out of compliance with this requirement shall be admissible. |
| 18 | The successful Bidder shall submit all test reports declarations and Checklist as specified in Appendix-C checklist-1(a), 1(b), 1(c) of the Employer's Requirements, for each type of LED luminaire before seeking manufacturing clearance after the award of the Contract. Manufacturing of the LED luminaires shall commence only after obtaining written manufacturing clearance from DMRC. Manufacturing clearance shall be issued by DMRC only after verification of the submitted test reports for compliance with the technical specifications and requirements of the Contract. In the event of failure by the Contractor to submit the requisite test reports or if the submitted reports are found to be non-compliant, fabricated, or otherwise unacceptable, DMRC shall have the right to withhold manufacturing clearance and take appropriate action in accordance with the provisions of the Contract, including rejection of the offered product, termination of the Contract, forfeiture of the applicable securities and debarment/blacklisting of the Contractor from participating in future tenders of DMRC as per the prevailing policy and applicable rules. |
