IGST is considered 18% in the aforesaid calculation. However, at the time evaluation, actual rate applicable at the time of TBO shall be considered. Foreign bidders can quote the price and receive payments either in Indian Rupees or US Dollars or Euros or Pound Sterling or Yen. However, prices for goods, works, or services (including Indian Agent Commission) sourced in India must be quoted and shall be paid by ONGC only in Indian Rupees to the extent of their Local Component Indicated in the bid. In all cases, Indian Agent commission shall be paid in INR only. The payment towards GST will be made by ONGC in Indian Rupees as per actuals, irrespective of Indian or Foreign bidder. In terms of GST Rate Notification No. 3/2017-IGST(R) dated 28.06.2017 as amended vide GST Notification No. 11/2025-IGST(R) dated 17.09.2025 concessional rate of 18% GST is applicable on procurement of specified goods required in connection with petroleum operations, upon submission of Essentiality Certificate (EC) issued by the authorized DGH official only if the merit rate of GST on specified goods is higher than 18%. In case the merit rate of GST is equal to lower than 18%, the applicability of said Notification No. 3/2017 IGST(R) would remain redundant. Indian bidders are required to quote in INR only, however Indian bidders can quote and receive payment in foreign currency to the extent of their import component indicated in the bid. The freight and Insurance elemerits must be quoted by Indian bidders in Indian Rupees only and payment will be made accordingly.
