| 1 | Desilting of S.W. drains and all sizes chamber by removing of covers and placing back the same in position Twice in a year of full length including disposal of malba to the designated malba dumping sites, all complete or as per direction of engineer in charge. The item includes the cost of labour, tools & plants, transportation, loading/unloading, and disposal of silt/malba. Nothing extra shall be paid to the contractor on any account.(Note:1.The agency shall ensure that drain/manhole covers are properly placed and secured immediately after completion of cleaning work.In case of any mishap affecting public safety due to open drains/manholes, the agency shall be held fully responsible.2.No drain cover/manhole cover shall be left open under any circumstances.If any drain/manhole cover is found missing or left open, a penalty of Rs. 3,000/- per cover shall be levied on the agency.3.The agency shall remove the excavated silt/malba from the site on the same day of cleaning. If malba is found lying at site beyond the same day, a penalty of Rs. 1,000/- per location per day shall be imposed.The work shall be carried out strictly as per the directions of the Engineer-in-Charge.) |

| 7 | Terms & Conditions:- 1. As this work is time bound & urgent work so if required more than one team shall be mobilsed by the agency in case of urgency/emergency, other than normal working hours within two hours of given instructions by Engineer-in-charge. No extra payment shall be made for this. Failure of which penalty of Rs 5000/- shall be imposed on the agency. 2. In Case of any emergency, the agency shall have to deploy the team even in odd hours i.e night hours to attend the emergency. Failure of which penalty of Rs 5,000/- shall be imposed on the agency.3. The agency should quote the rates accordingly as safe disposal within the municipal limits as per DPCC/NGT guidelines will be the sole responsibility of the agency and nothing extra shall be paid on this account by the department. Taking permission of MCD Dhalao/ Dumping site will be the sole responsibility of agency itself. 4. All safety measures/precautions are to be taken while doing the work. In case of any casuality, agency will be sole responsible. There will be no role of DDA in it. 5. During execution of work if any challan is received in this office from NGT, MCD,DPCC/CPCB, local body or any other govt. agency, the same shall be borne by the agency and if fails double the amount of challan will be recovered from the bill of agency. Nothing extra will be paid to agency on this account. 6. Rate is inclusive of all T&P required for the work and shall be arranged by the contractor itself.7. If the agency fails to do the work on the direction of Site Staff or Engineer-in-charge by any communication means i.e by phone, whatsapp or by Site Order Book within 24 hours then the penality of Rs 2000/- shall be imposed for per day delay. In case of any dispute, decision of Engineer-in-charge shall be final and binding.8. In case of any emergency, the agency shall have to deploy his team at any location under jurisdiction of DPD-1 as and when directed by Engineer-in-charge. Failure of which penalty of Rs 5,000/- will be imposed and work will be forfeited. Decision of Engineer-in-charge will be final and binding.9. While doing work if any of Drain Cover will be broken by the staff deployed by the agency then same will be replaced by the agency and no extra payment will be given in this account.10. The agency shall submit before and after GPS enabled photographs/videos of every day of work. Failure of which penalty of Rs 500/- per day will be imposed.11.
