Note: - This item to be used for maintenance work judicially, necessary deduction for scaffolding in the existing item to be done. |
| 15 | Providing and erecting 2.00-metre-high temporary barricading at site; each panel of size 2.50mx2.00m made of 40x40x6mm angle iron or 50x50x3mm hollow MS tube posts/horizontal members/ bracings covered with 1.63mm thick MS sheet. The sheet shall be fixed with 30x5mm MS flat by suitable welding/riveting. The panels shall be made so that gap of 50cm above the ground is available making overall height as 2.5m. MS channel ISLC 75 @ 5.70 kg/m, 50cm long shall be provided at the bottom having oval shaped holes of size 50x25mm at both ends with 50cm long MS angle 40x40x6mm bracing. Suitable arrangement shall be made to fix the barricading to avoid from overturning by providing 250mm long expansion fasteners at both ends. The work shall be executed as per drawing/direction of Engineer-in-Charge which includes writing and painting, arrangement for traffic diversion such as traffic signals during construction at site for day and night, glow lamps, reflective signs, marking, flags, caution tape as directed by the Engineer-in-Charge. The barricading provided shall be retained in position at site continuously i/c shifting of barricading from one location to another location as many times as required during the execution of the entire work till its completion. Rate include its maintenance for damages, painting, all incidentals, labour materials, equipment and works required to execute the job. The barricading shall not be removed without prior approval of Engineer-in-Charge.(Note :- One-time payment shall be made for providing barricading from start of work till completion of work i/c shifting. The barricading provided shall remain to be the property of the contractor on completion of the work) |

| 22 | Notes :-1 THAT the agency shall carry the demolition items, equipment’s, instruments and manpower required for carrying out the same to the site of demolition at its own expenses. Nothing extra shall be payable by the authority to the agency in this behalf.2 THAT the labour/ manpower employed by the agency shall always be employees of the agency and under no circumstances the authority shall have to do anything with the labour/ manpower. Any injury caused to the manpower, or damage to the demolitions items/ equipment’s/ instruments shall be the sole and exclusive responsibility of the agency.3 THAT the agency is required to carry out an insurance of all its demolition items/ equipment and instruments which shall cover the third party claim also. Further the agency is required to get itself insurance protection in respect of any injury to the labour/ manpower employed by the agency for the purpose of carrying out any requisite demolition. It is specifically agreed that any claim on the insurance company in respect of any damage to the demolition items/ equipment/ instruments or claim in respect of any injury to the labour employed, shall be borne by the agency exclusively and the authority shall have no concern with the same. The demolition equipment wherever required to be operated manually, shall be operated by persons employed by the agency and the authority shall have no concern in respect of the terms or incidents of employment of such persons.4 THAT the authority shall be entitled to make recovery at double the accepted rates in respect of any loss of damage suffered or sustained by it because of the failure of the agency to perform punctually. It is specifically agreed between the parties that in case any such amount become payable by the agency to the authority. It is further specifically agreed the decision in this behalf of Engineer-in-charge DDA shall be final and binding on the agency.5 THAT in case of unsatisfactory observance of the terms and conditions of the agreement, the authority shall have the right to terminate the agreement. However, before such termination, the authority shall serve on the agency a notice to show cause as to why the present agreement be not terminated. Such notice shall be duration of 07 clear days from the date of the receipt of such notice by the agency.6 THAT the agency shall, simultaneously after signing of the agreement, submit a certificate along with agreement with equipment supplier if any to the Engineer-in-charge that all demolitions items, equipment as well as manpower whenever required for the demolitions shall be kept readily available at shortest time gap and the contractor shall be informed about the demolition programme either through letter, telephonically, Whatsapp, E-mail or by any other means a day before demolition programme by 9:00 pm.7 It is specifically agreed that in case of any failure/ non-compliance on the part of the agency, in respect of the supply of any equipment, manpower, the Engineer-in-charge shall be entitled to arrange requisite demolition equipment, and manpower at the risk and cost of the agency, also 10000/- Penalty per day shall be imposed. It is further specifically agreed that any loss or damages suffered by the authority because of any non-fulfilment of the agencies obligations under the agreement or violations of the terms and conditions of the agreement by the agency shall be recovered from the agency.8 THAT contractor shall be paid 50% (Fifty percent) of the awarded rates for equipment and transport in case the demolition programme failed/could not be carried out due to any reason at site.9 In case any equipment or machinery becomes unserviceable, during the execution of demolition programme, the rates/ reduced rates be paid to the agency as per the recommendations of the Engineer-in-charge and it shall not be more than 50% of quoted/awarded rates .10 Executive Engineer ensure that all the dismantled material received during the course of demolition at site will be the property of DDA and same shall be kept in record.The agency has to completely clean the demolition site by removal of malba complete in all respect & disposal of malba in nearby low laying area of DDA/approved dumping ground of MCD on as directed by Engineer-in-Charge.11 Agency shall have to ensure the valid fitness certificate, PUC in respect of all vehicle/ machinery required under Motor Vehicle Act prevailing at the time of demolition along with valid license for operating vehicle/ machinery.12 The contractor shall provide personnel safety equipment to all the manpower engaged on work.13 All labours will be in same colour of labour reflective jacket. 14 Agency may be asked to carryout up to three programmes in a day depending on job requirements as decided by Engineer-in-charge. In case of failure to supply equipment and manpower etc., punitive action shall be taken under relevant terms and conditions described above.15 T&P provided by agency should be verified from concern demolition in-charge.
