To perform such services and execute such works covered under the \\"TERM CONTRACT FOR ARTIFICERS WORK IN OTM AND MD ACCN OF THE ZONE A AREA IN THE AREA OF AGE B/R II UNDER GE (N) AHILYANAGAR \\" upon the terms and conditions contained or referred to in the tender documents and upon the conditions as may be demanded and as are enumerated in the aforesaid MES Schedule of rates during a period of 365 (three hundred sixty five) days from the date mentioned in Acceptance letter at the rates contained in the MES standard Schedule of Rates 2009 Part I specifications including amendment 1 to 3 and MES standard schedule of Rates 2020 Part II Rates including amendments 1 to 122 and section 30 : Runway & pavements (here-in-after and in IAFW-2249 referred to as MES Standard Schedule) and at such other rates as may be fixed under the provisions of condition 62 and further agree to refer all disputes as required by the condition 70 of IAFW-2249 (General conditions of Contracts) to the Sole Arbitrator of a serving officer having

degree in Engineering or equivalent having passed final/direct final examination of Sub division Building and Quantity Surveying of Institution of Surveyor (India) recognized by Govt. of India to be appointed by Chief Engineer Pune Zone, Pune or in his absence the Officer officiating as Chief Engineer Pune Zone, Pune whose decision shall be final, conclusive and binding.

Notes :- (i) The bidders have to select the option of percentage \\"Excess (+)\\" or \\"Less(-)\\" available at the cell address E19 of the BOQ to quote the precentage above or below MES Standard Schedule of Rates Part-II 2020 with applicable errata/amendments. If no such percentage are offered it shall be deemed as AT PAR or Nil percentage with SSR rates. (ii) Bidders shall insert the percentage as mentioned in note (i), of this BOQ (here-in-before). (iii) Bidders shall select excess (+) or less(-) in column 4 of 19th row of this BOQ.

(iv) Amount of Rs. 30.00 lakh (Rupees Thirty Lakhs) inserted by MES under rate column and the total amount reflected is as a rough guidance and for refrence only. The same has been entered only for preperation of comparative statement according to e-tendering system. The acceptance of contract offer shall be done for quoted precentage rate on MES SSR 2020 . The work order for variour works/services shall beplaced on the rates contained in MES SSR 2020 duly adjusted by the percentage quoted by the bidder.It is not the tender amount and will not be considered after acceptance of tender.The tender shall be accepted at uniform percentage quoted by the bidder.(v) Total estimate of any single work,job or services shall not exceed as defined in condition 4A of IAFW 2249.

(vi) Contractor special attention is invited to condition 4A WORKS TO BE CARRIED OUT (APPLICABLE ONLY TO TERM CONTRACTS) and condition 56 TERMINATION OF CONTRACTS(APPLICABLE ONLY TO TERM CONTRACTS) of IAFW 2249 General Conditions of Contracts are strictly to be followed.(vii) It is an express condition of this contract that the amount to total works/services required to be done under this contract can vary to any extent irrespective of the amount worked out/mentioned in this BOQ sheet and the contractor shall be bound to execute such works/services at the rates contained in MES SSR 2020 Part-II duly adjusted by quoted precentage rate during the contract period .No claim whatsoever shall be entertained due to increase or decrease in quantum of works required to be done/work done.
