If IREPS/ HRMS/ all biddersAIMS/ IRPSM Application total servicefailure occurred due to issue in PKIsolution of e-Mudhra then penalty will beimposed @Rs 800 per Hour. In case ofpartial failure due to PKI solutionintegration then penalty will be imposed@Rs 400 per Hour. Penalties shall becalculated on the basis of total servicefailure as well as Partial failure. In caseboth are applicable the higher one shallbe charged.Penalties shall be deducted from theamount due for payment under thiscontract. In case penalties exceed theinvoice amount, the bidder shall have todeposit the due penalty amount within 7days from the date of issue of demandletter. In case the bidder does not depositthe penalty amount within stipulatedtime, CRIS reserves the right to recoverthe due amount as under: a) Fromsubsequent bills for ATS charges etc. orany other bill pertaining to this contract,b) From any other pending bills of thebidder in CRIS. c) From Security deposit /PBG Bond furnished for this contract orany other contract. The overall penalties annually shall becapped to 10% of the full contract valueincluding taxes, duties etc. This is inaddition to LD.
