If repeatedly operator is not available contract shall be terminated by M/s AM/NS without any notice to the contractor. Single Point of contact should be available for all the equipment deployed <(>&<)> Daily report to be submitted to our Engineer-In-Charge. 02) Equipment Maintenance schedule/plan should be submitted to Engineer In-Charge as to have equipment in healthy condition. Without submission of maintenance schedule plan, equipment cannot be released for maintenance. 03) The equipment should be fit with proper braking, lighting; horn system etc From SAFETY point of view and also the Equipment should comply with our HSE policy requirement. The operator should have Eye test done by the Approved Agency and shall be submitted. 04) HSD charges will be in contractor’s scope. 05) HSD, Spares, consumables, and Lubricants required for running of equipment shall be arranged by contractor. Hire charges shall include cost of such items and no separate payment shall be made for the same. We shall not guarantee no minimum payment for equipment’s being deployed @ site. 06) Machine should be available for 24 hours a day @ site. Equipment/Operator shall be available all the time at our site only so that it can be used in case of emergency works. 07) Log sheet had to be prepared on daily basis as per our format giving details of work done and location and is to be certified by our engineer in charge. 08) Wheel Guard is required to be provided for Hydra so that safety related issues can be taken care. 09) The operators should be equipped with all PPE for operating hours of machine. All safety measures have to be taken care by the contractor. 10) The operators should have valid License as per R.T.O. The Vehicle has to operate as per R.T.O norms <(>&<)> our safety norms 11) The Vehicle should adhere to all statutory norms (Load test and regular tests shall be done to ensure vehicle is in healthy condition and reverse horn should be compulsorily in working condition). All the statutory requirements and vehicle operating condition and safety features such as Overload warning device, winch extension warning or over hoist warning, Hose Failure Protection device <(>&<)> winch Fail safe brakes, vehicle proximity beep <(>&<)> display on screen sensor, Driver Fatigue Sensor shall be Verified by Safety In-Charge and if functioning/validity of calibration certificates shall be verified. If found satisfactorily then only vehicle shall be allowed for Deputation. 12) Contract can be terminated at any point of time with 07 days’ prior notice within the contract period in such case no compensation will be paid what so ever the reason 13) The operator medically fit and Eye test report shall be submitted every 6 months. 14) The vehicle working condition shall be approved by Competent Agency/Person and to be submitted on Yearly Basis. 15) Driver Induction through scrum system is mandatory and the necessary compliance of the gate pass procedure is to be followed and OT Hours of the vehicle to be claimed with the driver attendance and OT Hours of Scrum report. The un-planned stoppage of the equipment, due to any reason (men/machinery), during work is considered as breakdown. 2. Equipment is allowed for planned maintenance with prior permission of Engineer In-Charge upon providing the standby equipment. 3. Alternative Equivalent or higher capacity machine to be arranged under contractor scope. 4. The break down hours/days will be recorded in shift logbook. 5. In case equipment/machine is not arranged at the right time by the contractor, AMNS has the right to arrange from alternative contractor and the difference of cost incurred shall be debited to the contractor. 6. The contract is liable for termination without notice period, if a) The number of break downs is more than three times in a month. b) Prolonged breakdown for more than two days and alternative is not arranged by the contractor starting of third day. AMNS reserves the right to terminate the contract on above grounds. 7. The standby equipment ‘run hours’ are also considered in the run hours of the ‘equipment on hire’ with the company. 8. Our Engineer In-Charge is final authority on deciding the total breakdown hours. Period of Contract: The contract is valid for the period 1 year which may be extended for one or more year(s) on existing rates, terms and conditions, upon satisfactory performance and mutual consent. Responsibility to any loss: Contractor will have to submit an undertaking at the time of award of contract that any loss, occruing to the his property, during the contract period (and extensions, if any), will be borne by the contractor at his own cost. The assessment of damage made by AM/NS is final. Insurance: Insurance of men and machinery is in the scope of the Contractor. AMNS is not responsible for any loss or damage of any kind.
