Tender For Request for proposal For Selection Of Tax Consultant For Various Items Of Work For Noida - 1) NOIDA seeks to appoint Tax Consultancy Firm for Assisting and Providing Advisory Services in all sort of Tax Matters (Both Direct and Indirect Tax). The selected consultant will be responsible for verifying all type of taxes payable/ receivable by the Authority as well as representations at the Income Tax Tribunals. They are required to provide advisory services for any tax matter referred by the Authority. It is expected that the team of the selected firm will have necessary expertise, experience, capabilities and knowledge in the area of IT Act 1961 and other tax laws in India and abroad, which shall broadly cover the areas listed below. This listing is not exhaustive and should be regarded as an outline only. The assignment will include following work: a. Drafting of appeals and appearance before the appellate authorities - including but not limited to Commissioner of Service Tax/GST (Appeals) and Custom Excise & Service Tax Appellate Tribunal, or any other Appellate Tribunal including GST for this purpose. (This shall include the work pertaining to legal representation/advice/drafting relating to the tax matters, for which no additional fee shall be paid). b. Advance rulings under taxation laws c. Follow up with tax authorities. Filing of replies for various tax related matters from competent authorities. d. Representation of matters pending before appellate authority, Hon’ble Supreme Court and Hon’ble High Court of Lucknow, Delhi and Prayagraj. e. Provide opinion to Noida on valuation and taxability of various income streams, interest, service charges, fees and commission, etc.) dealing with related parties like subsidiaries, associates etc. f. Preparation and filing of the income tax return of the Authority and any other related returns as per their due dates or on annual basis and generation of 26 AS g. Assist in direct tax & Indirect tax proceedings i.e. preparation of details required to be submitted to the tax department and appearance before the tax authorities. h. Preparation and filing of writs / affidavit / rejoinder / SLP / appeal against penalty orders / tax liabilities issued against Noida i. Matters relating to TDS on interest paid by various Banks j. Matters pertaining to short / nonpayment of service tax on renting of immovable property services. k. Computation of Advance Tax under the Income Tax Act on quarterly basis. l. Computation of provision for income tax for annual closing of accounts. m. Preparation and filing of required applications with tax authorities. n. Preparing direct tax & indirect tax status report on quarterly basis. o. Opinion on matters relating to EPF / ESIC cases pending before RPFC, Hon’ble High Court and other authorities p. Furnishing information/ opinion to Noida on the various day to day tax matters. q. Update/ guidance on change in any tax laws and their implications. r. Certificates if any to be issued in pursuance to the provisions of the Income Tax Act 1961 s. Verification of TDS computation with regard to payment towards salary and perquisite of every employee of Noida and verification of TDS certificate as per Form 16. t. Appearing before the tax authorities in connection with show cause notices. u. Assist in compliance to ICDS (Income computation disclosure standards) v. Address any other tax references made by Noida to the consultant w. Noida has one GSTIN and two GST TDS registration. 2) Submission of Reports / Progress Updates / Effort Estimates a. Works log of the tasks assigned to the Consultant should be presented to the concerned officials at Noida on a quarterly basis b. NOIDA has empanelled Advocates who will be representing cases in High Court and Supreme Court. The Tax consultant is expected to assist and guide the Advocate on such matters. However, representation in ITAT, Commissioner (appeals), CESTAT or any other relevant semi judicial court will have to be done by the Consultant.
