Scope Of Work Is As Below:- The Security And Allied Service Provider Herein Has Agreed To Provide Such Services Upon The Terms And Subject To The Conditions Herein After Mentioned, It Is Hereby Agreed And Declared As Follows: 1. The Company Hereby Agrees To Engage To Engage The Firm To Safeguard Its Property ( Both Movable And Immovable ) Situated In Its Site At Bharat Petroleum Corporation Limited, Ranchi Depot, Station Road, Chutia, Ranchi, Jharkhand-834001 For A Period Of 2 Years W.E.F 01.07.2021 To 30.06.2023. 2. The Firm Has Assured The Company That Company’S Property ( Both Movable And Immovable ) Situated In The Site Will Be Secured Round A Clock And The Schedule Security Personnel For Guiding The Site Would Be As Below: That The Deployment Of The Guards Will Be Maximum Of 10 Numbers As Per The Sponsorship Letter From Dgr On Any Working Day ( Actual Deployment Of No. Of Guards + Supervisor In Shift Will Be Decided By Site In-Charge ) While The Company Would Not Make Payment For More Than 10 Securities For Every Working Day Keeping In View The Provision For Leave Reserve ( Relieving Charges ) . Currently, We Shall Be Deploying Only 9 Number Of Guards For Our Plant And Payment Shall Be Made For 09 Number Of Guards Only Also Bharat Petroleum Corporation Limited, Ranchi Depot Will Be Resited To Which We Will Have Requirement Of Less Number Of Guards And The Security Agency Shall Comply With The Same. 3. Firm Hereby Undertakes A. Not To Allow Any Unauthorized Person Into The Site. B. To Maintain A Register Recording All The In Coming And Out Going Materials From The Site, As Well As Entry And Exit Of Personal From The Site. C. To Check The Out-Going Materials And Ensure That The Same Is Being Issued With A Gate Pass And Further To Ensure That The Outgoing Materials Is In Accordance With The Gate-Pass Details. D. To Check, Control And Search The Staff Of The Company As Well As Of The Contractors At The Time Of Their Entry And Departure From The Site As Well As Search Them While They Are In The Site As And When So Required By The Site In-Charge. E. To Ensure That No Person Enter The Administrative Block And The Site Area Without Being Identified And To Ensure That No Annoyance Or Disturbance Is Created After Entering Into The Premises. F. To Keep Vigilance Inside And Outside The Boundary Of The Site. G. Lock And Open All Office Rooms, Switch On / Off Lights, Air Conditioner And All Other Electrical Gadgets Including Generator &Amp; Fir Engine. H. Attend The Telephone Calls While The Office Is Closed And Convey All Messages To The Concerned Company Officials. I. To Maintain All Log Books Where Details Events / Observations Of The Guards / Supervisor Will Be Recorded And Submit The Same To The Site In-Charge. J. To Maintain Liaison With The Local Police Authorites And With The Permission Of The Site In-Charge To Report Any Incident To The Local Police And Pursue Such Complaint With Police Authorities. K. To Carry Out Any Other Task In The Interest Of Security Of The Premises. L. To Ensure That Security Staff Maintain / Display High Degree Od Discipline At The Premises And While Dealing With Co’S Officials / Outsider Staff An Duty. 4. The Firm Covenants With The Company A. To Provide Additional Security Guards And / Or Supervisors To The Company As And When Required By The Company. The Payment In Respect Of Such Additional Staff Shall Be Made On The Same Basis As Mentioned In This Agreement. B. To Ensure That The Security Guards As Well As Security Supervisors Would Be Ex-Servicemen And That They Shall Be In The Age Group Of 35 To 55 Years Old. C. To Ensure That The Security Supervisor Deployed Shall Have Suitable Qualifications, Sufficient Experience And Good Personality. D. On The Request Of The Site In-Charge To Remove Any Of Its ( Viz. Firm’S ) Employee From Company’S Premises Mentioned Above. E. It Shall Be Fully Responsible For The Verification Of The Reliability Of Each Individual Deployed By It In The Company’S Premises. F. It Shall Also Be Responsible For The Good Conduct Of The Personnel Deployed By It In The Company’S Premises And They Shall Not Consume Alcohol And Smoke While In The Company’S Premises And They Shall Not Come To The Company’S Premises After Consuming Alcohol. G. To Comply With All Status, Rules, Regulations Including Employees State Insurance Act, Employees Provident Fund ( And Miscellaneous Provisions ) Act , Minimum Wages Act., Contract Labour ( Regulation &Amp; Abolition Action, 1970 ) , Payment Of Bonus Act And Shall Pay Wages Which Shall Not Be Less Than Minimum Wages Prescribed By Dgr To The Employees Deployed By It In The Company’S Premises. H. All Issues / Dispute, If Any Arising Out Of Employment / Engagement Of The Security Staff At The Site By The Firm Shall Be Resolved Directly With The Concerned Staff By The Firm Without Reference To The Company. I. To Take Out The Necessary License Under The Contract Labour ( Regulation &Amp; Abolition ) Act And To Get The Same Renewed From Time To Time. J. The Firm Shall Ensure To Make Payment Of Provident Fund ( Pf ) , Esic Contributions Or Any Other Local Levy Direct To The Authorities In Respect Of The Employees Engaged By It And Forward Necessary Clearance Certificate From Concern Department On A Period Basis To Bpcl For Their Record. K. The Firm Shall Maintain Regularly, Punctually And Faithfully An Attendance Register Of The Employees Deployed By It In The Company’S Premises Showing Therein The Person’S Attending Their Duties And The Firm Shall Produce The Register As And When So Required By The Company. L. The Firm Shall Depute / Change Any Security Staff At The Location In Consultation With Site In-Charge. They Are Also Required To Submit The Credentials Of Security Staff I.E. Name, Father’S Name , Address And Documentary Evidence As A Proof Of Ex-Servicemen Before Deployment. M. The Firm Shall Also Ensure That The Staff Deployed At The Company Premises Will Be Fully Trained In Fire Fighting Operations And Shall Operate Fire Fighting Equipments As And When So Required. The Firm Shall Maintain A Register Of Training In Fire Fighting Imparted By It To Its From Time To Time. N. That The Firm Will Also Ensure That The Staff While Deployed In The Company’S Premises Shall Wear Proper Uniforms Shall Include Sweater, Shoes, Caps, Identification Cards ( I-Card ) Etc. The Firm Shall Also Ensure That The Uniforms Are Neat And Clean. The Cost Of Such Expenditure Is Included In The Contract Rate. O. To Test Fire Fighting Equipment Installed In The Site And To Ensure That The Said Equipment Is Useable Condition At All Time And Ensured “Safety First Safety Must” At Any Circumstances. P. To Rotate The Security Staff Regularly At An Interval Of Six Months. 5. The Firm Agrees And Accepts That This Agreement Has Been Arrived At Between The Company And The Firm Or Principal To Principal Basis. The Firm Further Agrees And Accepts That It Is Not And Will Not Be A Contractor Of The Company. The Employees Engaged / Deployed By The Firm For The Purpose Of Carrying Out Its Business Under The Agreement Shall Be The Employees Of The Firm And They Shall Have No Privities Of Contract With The Company. 6. That The Company Undertake To Pay To The Firm As Per Schedule Of Rates Given In The Annexure-1 That The Firm Shall Ensure Disbursement Of Wages Etc To Their Employees On Or Before The 7Th Day Of The Next Month For Previous Month Works On Their Bank Account And Forward The Same For Company Record. 7. The Firm Shall At All Times Fully Indemnify The Company From And Against All Losses, Damages, Claims, Suits Etc Arising From And In Connection With Injury To Person Or Property Or Otherwise Whatsoever In Connection With Matters Connected With This Agreement Provided Such Loss Or Damage Is Not Caused Due To The Negligence Of The Company Employees. 8. The Firm Will Ensure That He Or His Partners ( If Is A Partnership Firm ) Or His Employees, Representatives, Agents Shall Not Smoke Or Carry Match Boxes, Mechanical Lighters Etc. Inside The Company’S Premises And Would Ensure That Their Employees Do Not Smoke In The Site Or Within The Safety Distance Limits. 9. No Sub-Contract Shall Be Allowed Or Responsibility Allowed To Be Shifted By The Firm From Provision Of The Above Security Arrangements. 10. If At Any Time During The Period Of The Contract, If It Is Observed By The Company, Its Authorized Representative That The Service Rendered By The Firm Are Not To The Satisfaction Of The Company Or Any Terms Of The Agreement Are Violated, The Company Will Have The Right To Terminate The Contract Without Any Notice To The Firm. 11. Notwithstanding Anything To The Contrary Herein Contained, The Agreement Can Be Terminated At The Option Of The Corporation By Giving One Month Notice To The Agency In Writing Without Assigning Any Reason Whatsoever. The Agency Can Submit Resignation By Giving Three Months Prior Notice And Physical Removal Of Its Staff From Our Site Before Expiry For Termination Of The Agreement. 12. The Court In The City Of Kolkata Alone Shall Be Exclusive Jurisdiction To Entertain Any Suit, Application Or Other Proceeding In Respect Of Any Claim Or Dispute Arising Under This Agreement. 13. Any Dispute Or Difference Of Any Nature Whatsoever, Any Claim, Cross-Claim, Counter-Claim Or Set Off Of Bpcl / Contractor Against Omission Or Account Of Any Of The Parties Hereto Arising Out Of Or In Related To This Agreement Shall Be Referred To The Sole Arbitration Of Director ( Marketing ) Of Bpcl Or To Some Officer Of Bpcl Who May Be Nominated By The Director ( Marketing ) . In The Event The Arbitrator Being Unable Or Refusing To Act For Any Reason Whatsoever, The Director ( Marketing ) Of Bpcl Shall Designate Another Person To Act As An Arbitrator In Accordance With The Terms Of The Said Agreement
