The Contracting Authority Reserves The Right To Modify The Contract According To The Provisions Of Art. 221 Paragraph (1) Letter A), E) And F) Of Law 98/2016 With The Subsequent Modifications And Completions, Provided That It Does Not Fall Within The Provisions Of Art. 221 Para. (7), That Is, It Does Not Represent A Substantial Change. The Possible Changes That Can Intervene During The Period Of The Contract Refers To The Following: 1. When The Contractor Is Replaced By A New Entrepreneur And Only In The Case Where The Rights And Obligations Of The Initial Entrepreneur Resulting From The Public Procurement Contract Are Taken, As A Result Of A Universal Succession Or With A Universal Title Within A Reorganization Process, Including The Process, By Another Economic Operator Who Fulfills The Qualification And Selection Criteria Initially Established, Provided That This Modification Does Not Involve Other Substantial Changes Of The Public Procurement Contract And Is Not Realized In Order To Circumvent The Award Procedures Provided By Law No. 98/2016 Regarding Public Procurement, With Subsequent Modifications And Completions; 2. Changing The Name And/Or Form Of Organization Of The Company, Changes That Do Not Attract The Creation Of A New Legal Person; 3. Changes Generated By The Increase Or Reduction Of A Quantity Of Works In The List Of Quantities, When Such An Increase Or Reduction Is The Result Of The Measure Provided In Clause 49 [Measurement, Evaluations And Provisional Amounts; 4. Changes Generated By The Increase Or Reduction Of A Quantity In The List Of Quantities As A Result Of The Modification Of The Specifications Or Drawn Parts; 5. Changes Generated By The Requests Of The Owners Of Utility Networks; 6. Modifications Of The Corridor/Expropriation Corridor That Lead To The Need To Carry Out Additional Works And/Or To Renounce The Accomplishment Of Existing Works In The Contract; 7. Preparing The Execution Time. This Is Achieved On The Basis Of The Contractual Mechanism Provided In Clause 35 [Extension Of The Execution Time] From The General Conditions Of The Contract, Without Prejudice To The Beneficiarys Right To Apply To The Entrepreneur The Penalties And/Or Sanctions Provided In The Contract, As A Result Of The Appearance Of Independent Elements Of The Beneficiary Or The Entrepreneur; 8. Modifications Of The Technical Execution Project, Which Results From The Adaptation Of The Technical Project To The Reality In The Land, Including Changes Of Punctual Technical Solutions; 9. Modifications Generated According To Sub-Clause 37.11 [Proposal For Modification Initiated By The Entrepreneur]; 10. Modifications Generated By Changes In Quotas, Positions And/Or Dimensions Of Some Categories Of Works/Works Of Works As A Result Of The Situation In The Field; 11. Changes Generated By The Amendments Of The Land, The Hydrographic Network Of The Above
