1) The Subject Of The Contract Is: Renovation Of The Municipal Road Within The Town Of Nowe Zambrzyce. 2) The Detailed Scope Of The Subject Of The Contract Has Been Specified In The Project Documentation And Stwior Constituting Annex 10 To Swz.3) The Contracting Authority Also Transfers The Number Of Works (Constituting Annex 11 To Swz). Attached To Swz, They Are Only An Example Of The Scope Calculation And Cannot Be The Only Basis For Calculating The Price Of Performing The Entire Subject Of The Contract. The Contractor Should Remember, Regardless Of Any Restrictions Suggested By The Description Of Each Item And/Or An Explanation That The Price Presented In The Offer Is Payment For Work Done And Completed In Every Respect. It Is Believed That The Contractor Took Into Account All Requirements And Obligations, Regardless Of Whether They Were Determined Or Suggested In The Preface. 4) If Technical Documentation Would Indicate Trademarks, Patents Or Origin - The Contracting Authority, In Accordance With Art. 99 Para. 5 Of The Public Procurement Law, Allows The Offer Of Equivalent Solutions. Materials Or Devices From Specific Manufacturers Specify The Minimum Quality Parameters And Utility Features, Which The Materials Or Devices Offered By The Contractor Must Meet To Meet The Requirements Set By The Contracting Authority. Materials Or Devices From Specific Manufacturers Are Only A Qualitative Model Of The Subject Of The Contract. Speaking Of Sample Names Of The Manufacturer Is Therefore Not Aimed At Violating Art. 99 Para. 4 Of The Public Procurement Law, But Clarifying The Level Of Expectations Of The Employer In Relation To A Specific Solution. Using The Names Of Producers Or Products Is Only An Exemplary Character. The Employer, Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product When Describing The Subject Of The Contract, At The Same Time Allows Equivalent Products With Qualitative Parameters And Utility Features At Least At The Level Of The Indicated Product, Thus Recognizing Each Product With The Indicated Or Better Quality Parameters And Utility Features. 5) Material From Demolitions Belongs To The Contractor. The Place Of Debris, Spoil And Utilization Remains The Responsibility Of The Contractor And Constitutes Its Cost, Regardless Of The Distance Of Such Exports Suggested In The Pre -City.
