The Award Procedure Is Initiated Under The Incidence Of The Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Of <<Providing Electrical Minibuses Within The Project The Purchase Of Electric Minibuses For Students In Iași County, Code 14 >> Is Conditioned By The Extension Of The Financing Contract No. 12001/ 12.09.2023. Considering The Provisions Of Law No. 98/2016 And The Government Decision No. 395/2016, The Iaşi County Council, As A Contracting Authority, States That It Will Conclude A Contract With The Stated Bidder, Insofar As There Will Be Funds Available To The Purchase, Respectively Non -Reimbursable Funds, By Extending The Duration Of The Financing Contract No. 12001/ 12.09.2023 And The Period Of Implementation Of The Project The Acquisition Of Electric Minibuses For Students In Iași County. Currently, The Duration Of The Financing Contract No. 12001/ 12.09.2023 And The Period Of Implementation Of The Project Is 30.09.2025. If, For Regardless Of Reasons, The Extension Of The Financing Contract And The Period Of Implementation Of The Project Is Not Carried Out Until 31.12.2025, The Contracting Authority Reserves The Right To Apply The Provisions Of Art. 212 Para. (1) Letter. C) The Second Thesis Of Law No. 98/2016, Being Impossible To Conclude The Public Procurement Contract. The Bidders Within This Procedure Accept The Use Of The Suspensive Condition Above, Assuming Their Full Responsibility In Relation To The Possible Losses They Could Suffer In The Situation Described. The Bidders Within This Procedure Accept The Use Of The Special Conditions Above/ Suspensive Clause, Assuming Their Full Responsibility In Relation To The Possible Damages They Could Suffer In The Situation Described. The Bidders To The Procedure Assume, By Submitting The Offer, The Obligation To Extend The Validity Of The Offer And The Guarantee Of Participation, To The Simple Request Of The Contracting Authority, If The Contracting Authority Will Be In The Situation Of Applying The Suspensive Clause.
