Pursuant To Art. 120 Paragraph 1, Lett. A) Of The Code, Rai S.P.A. Reserves The Right To: - To Extend The Duration Of The Relative Contract For The Time Necessary To Be Able To Use The Entire Contractual Amount, If The Contractual Amount Should Not Be Exhausted At The Expiry Of The Term Of Contractual Duration (Without Prejudice To The Non -Binding Nature Of The Relative Amount); - To Insert Or Exclude From The Contract, In Whole Or In Part, Settlements /Location That Enter Or Come Out Of The Legal Availability Of The Client. And In Particular: (I) Settlements /Locations Sites In The Municipality Of Sanremo (And Neighboring Areas); (Ii) Settlements /Locations Sites In One Or More Different Italian Municipalities, Where, For Surviving Circumstances, The Client Organized A Radio And Television Program, Possibly With Different Title, Similar For Production Needs To The Festival Of The Italian Song And Which Therefore Provides A Similar Perimeter Of The Services Subject To This Contract. In Exceptional Cases, Upon Occurrence Of The Conditions Indicated In Art. 120 Paragraph 11 Of The Code, During Execution, The Contract May Be Extended For The Time Strictly Necessary For The Conclusion Of The Procedure For Identifying The New Contractor Of The Code. In This Case, The Contractor Will Be Required To Carry Out The Services Subject To The Contract To The Same Prices, Agreements And Conditions Provided For In The Contract. The Global Value Of The Contract Includes, Pursuant To Art. 41, Paragraph 14, Of The Code, The Costs Of The Labor Non -Discount (Without Prejudice To The Provisions Of The Anac Type Call), Calculated By The Contracting Authority - On The Basis Of The Estimated Mountain Hours And Of The Hourly Cost 6 Of The Ccnl For Personnel Dependent On Companies Operating Services Of Logistics, Freight Transport And Shipping (Alfanumeric Code I100) - In About 90% Of The Total Tender Amount. The Possibility Remains For The Economic Operator To Demonstrate That The Overall Reduction Of The Amount Derives From A More Efficient Corporate Organization, As Best Indicated In The Aforementioned Anac Type Announcement.
