Under Such Conditional Award Of Contract, The Successful Tender Shall Be Binding For An Additional 30 Days. .3 The Contract Will Be Awarded On Condition That It Is Within The Respective Municipal Budgets For The Supply Or Purchases Made In The Name And On Behalf Of The Grand Falls Regional Municipality. .4 Withdrawal Of Tender Means Claim By Owner On Bid Bond Or Forfeiture Of Bid Security, Or Both, As Damages For Costs. .5 Formal Notification Of Award Or Rejection Shall Be Done Either By Mail Or Fax Or Hand Delivered. .2 Acceptance Of Offer: .1 The Lowest Or Any Tender Will Not Necessarily Be Accepted. The Owner Reserves The Right To Accept Or Reject Any Or All Offers. .2 Tenders Received After The Specified Closing Time And Date Will Not Be Accepted. .3 After Acceptance By Owner, Consultant Will Issue To Successful Bidder Written Tender Acceptance. .4 After Tender Has Been Accepted, Unsuccessful Bids Will Be Returned To Respective Bidders With Submitted Bid Securities And Other Requested Enclosures. .5 The Failure Of The Successful Bidder To Execute The Contract Within Fourteen (14) Days Notice Of Bid Acceptance Shall Give The Owner The Right To Notify The Bid Bond Surety Of The Bidders Default And Recover An Amount Equal To The Value Of The Bid Bond Or Certified Cheque In Lieu Thereof. .6 The Bid Bond Or Certified Cheque In Lieu Thereof Of Any Unsuccessful Bidders Shall Be Returned Within Seven (7) Days Of Execution Of The Contract, Together With Any Related Enclosures. 1.10 Limitation Of Liability And Waiver .1 Each Bidder, By Submitting A Bid, Agrees That: .1 Neither The Municipality Nor Any Of Its Employees, Agents, Advisors, Consultants, Or Representatives Will Be Liable, Under Any Circumstances, For Any Claim Arising Out Of This Tendering Process, Including, But Not Limited To, Costs Of Preparation Of The Bid, Loss Of Profits, Loss Of Opportunity, Or For Any Other Claim; And .2 The Bidder Waives Any Claim For Any Compensation Of Any Kind Whatsoever, Including Claims For Cost Of Preparation Of The Bid, Loss Of Profit Or Loss Of Opportunity By Reason Of The Municipalitys Decision To Not Accept The Bid Submitted By The Bidder, To Award A Contract To Any Other Bidder, To Delay The Award Of A Contract In This Tendering Process, Or To Cancel This Tendering Process, And The Bidder Shall Be Deemed To Have Agreed To Waive Such Right Or Claim. 1.11 Condition Of Award .1 As A Condition Of Award, The Successful Bidder(S) Agree(S) That Other Regional Municipalities From The Four Atlantic Provinces Shall Have The Advantage Of The Price(S) Accepted By The Grand Falls Regional Municipality Of 180 Days. .2 This In No Way Commits These Municipalities To Accepting This Rfq But Provides Them With The Opportunity To Take Advantage Of The Grand Falls Regional Municipality Pricing. .3 The Grand Falls Regional Municipality Is Not Responsible For Payment For Products Supplied To Other Municipalities.
