1. The Subject Of The Contract Is The Execution Of Construction Works As Part Of Investment Task No. 2023/15 Land Development At Zamoyski Street In Zakopane For Recreational Purposes. 2. The Scope Of Works And Works Constituting The Subject Of The Contract Includes, In Particular, The Construction Of: Pedestrian And Bicycle Routes, A Separate Playground, Small Architecture Facilities, Lighting And Monitoring, Traffic Lights, Retaining Wall, Dehydration And Fence. 3. A Detailed Description Of The Subject Of The Contract Is Determined By The Design Documentation, Template For The Performance Of Construction Works And Technical Specification Of Construction And Acceptance Of Construction Works (Stwiorb). 4. Pursuant To Art. 101 Para. 4 Of The Public Procurement Law, Hereinafter Referred To As Pzp, In A Situation Where In The Project Documentation Or Stwiorb, I.E. In The Documents Describing The Subject Of The Contract, A Reference To Standards, Technical Assessments, Technical Specification And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Public Procurement Law, And Such References Are Not Accompanied By An Or Equivalent Expression, The Contracting Authority Allows Equivalent Solutions Described In Each Such Norm, Technical Assessment, Technical Specification And Technical Reference System. In Connection With The Above, It Should Be Assumed That Each: Norm, Technical Assessment, Technical Specification And Technical Reference System Appearing In The Description Of The Subject Of The Contract Is Accompanied By Or Equivalent Words. 5. Pursuant To Art. 101 Para. 5 Of The Public Procurement Law, The Contractor, Who Refers To Equivalent Solutions Described In These Documents, Is Obliged To Prove By Joining The Relevant Evidence In Question Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Balance Meet The Requirements Set Out In The Description Of The Subject Of The Contract. 6. The Equivalent Devices And Materials Offered Must Have Appropriate Approvals Or Admission To Business Market Required By Law. 7. The Employer Reserves The Right To Apply For Designers Of Project Documentation For An Opinion On The Materials Or Devices Offered. This Opinion May Be The Basis For The Contracting Authority To Make A Decision To Accept Equivalent Materials Or Devices Or Reject The Offer Due To A Lack Of Equivalence. 8. The Contractor Will Perform Construction Works Corresponding To The Scope Specified In The Presented Project. 9. The Employer Allows The Possibility Of Occurring, During The Implementation Of The Subject Of The Contract, The Need To Perform Interchangeable Works In Relation To The Procedure Provided For In The Project Documentation That Does Not Increase The Contractors Remuneration, In A Situation Where The Performance Of These Works Is Necessary For Correct, I.E. In Accordance With The Principles Of Technical Knowledge And The Provisions Of The Contract In Force On The Day
