1. The Subject Of The Order Are Successive, Non -Cash Purchases Of Liquid Fuels Hereinafter Referred To As Fuels, For Vehicles And Devices Of The University Of Gdańsk. Classification Of The Common Order Dictionary (Cpv): 09132100-4 Unleaded Gasoline, 09134100-8 Diesel Oil. 3. Estimated Amount Of Fuel Ordered In 24 Months: 1) Unleaded Gasoline With An Octane Number Of 95, In The Amount Of 16,000 Liters, 2) Unleaded Gasoline With An Octane Number Of 98, In The Amount Of 12,000 Liters, 3) Diesel In 22,000 Liters. 4. The Employer Informs That The Amount Of Fuels Specified In Point 3 Is An Expected (Estimated) Amount, Not Binding To The Contracting Authority And May Change, Which Will Not Constitute A Change In The Contract. The Actual Amount Of Fuels Purchased Will Result From The Current Needs Of The Employer, And The Total Gross Remuneration Of The Contractor Will Not Exceed The Total Price Of The Offer. 5. The Contracting Authority Reserves The Right To Resign From The Implementation Of Part Of The Order, Up To 20% Of The Gross Value Of The Contractors Remuneration. In This Case, The Contractor Is Not Entitled To No Claims Against The Employer, In Particular The Claim For The Performance Of The Contract Up To The Full Amount Of This Amount Or For Payment Of Remuneration For An Unrealized Part Of The Order. The Resignation Provided For In This Paragraph Results In An Appropriate Reduction In The Final Value Of The Remuneration Due To The Contractor And Does Not Constitute A Change In The Contract Requiring The Conclusion Of The Annex. 6. The Contracting Authority Requires That The Fuel To Be Bought From The Fuel Contractor Meet The Requirements Set Out In The Regulation Of The Minister Of The Climate And The Environment Of 26 June 2024 On Quality Requirements For Liquid Fuels (Journal Of Laws Of 2024, Item 1018). 7. The Contracting Authority Requires The Contractor To Have At Least 30 Fuel Stations In The Pomeranian Voivodeship, Taking Into Account The Provisions Of Chapter Xvii Point 1 Item 3 Swz. The Availability Of Petrol Stations In The Pomeranian Voivodeship Is One Of The Criteria For The Assessment Of Offers. 8. Before Signing The Contract, The Contractor Is Obliged To Provide The Employer With A List Of Available, I.E. Active Gas Stations In Poland, With Particular Emphasis On The Pomeranian Voivodeship And Regulations In The Field Of Non -Cash Purchase Of Fuel In Force At The Contractor - Chapter Xxi, Point 6 Swz. 9. A Detailed Description And Scope Of The Subject Of The Contract Is Specified In: Subject -Price Form - Annex 1A To Swz And Draft Contract - Annex 4 To Swz. 10. The Contractor Is Obliged To Have A Civil Liability Insurance Policy In The Scope Of Conducted Business Activity Related To The Subject Of The Contract Throughout The Entire Period Of Implementation Of The Contract, For A Guarantee Sum Not Lower Than The Value Of The Gross Agreement Specified In § 3 Para. 1 Of The Draft Contract.
