Where In The Order Documents A Trademark (Brand), Manufacturer, Supplier, Patent, Origin, Source Or Special Process, Which Characterized Products Or Services Provided By A Specific Contractor, Was Indicated In The Order Documents Or Has Been Indicated By A Specific Contractor, Or There Was An Indication Of Standards, European Technical Assessments, Common Technical Specifications Or Other References Referred To In Art. 101 Paragraph 1 Point 2 Or Para. 3 Of The Act, The Ordering Party In Accordance With Art. 99 Para. 5 Of The Act Allows The Submission Of An Equivalent Offer Or In Accordance With Art. 101 Para. 4 Of The Act, Offering Equivalent Solutions In Relation To Those Indicated In The Documentation, Provided That They Provide Technical Parameters Not Worse Than Assumed In The Documentation And Will Be Consistent In Terms Of: A) Dimensions And Construction (Size, Type, Physical Properties, Number Of Components), B) Usable Nature (Identity Of Functions), C) Material Characteristics (Type And Quality Of Material), D) Parameters Technical (Strength, Durability, Technical Data, Hydraulic Data, Linear Characteristics, Construction), E) Safety Parameters, F) Emission Standards, The Contractor At Each Request Of The Contracting Authority During The Implementation Of The Contract Is Obliged To Show In Relation To The Indicated Materials Of Security Signs, Declaration Of Compliance Or Technical Approval Or Certificate Of Compliance With The Polish Norm Transferring European Norms Member Of The European Economic Area Transferring This Standard Or Polish Norm In The Absence Of A Polish Standard Transferring European (Or Equivalent Norm). Whenever The Documentation Of The Proceedings Refer To Polish Standards, It Should Be Understood As Polish Standards Transferring European Standards Or Standards Of Other Member States Of The European Economic Area Or Other Standards Or Equivalent Documents Referred To In Art. 101 Para. 1 Point 2 Of The Act. 1.6. The Contractor, Who Refers To Equivalent Solutions Described By The Contracting Authority, Is Obliged To Show That The Deliveries, Services Or Works Offered By Him Meet The Requirements Set By The Contracting Authority And To Submit, Together With The Offer Of Technical Cards Or Other Documents Confirming That The Balance Solution
