The Contractor, Who Refers To Equivalent Solutions, Is Obliged To Show That The Solution He Offers Meets The Requirements Set By The Contracting Authority. In This Case, The Contractor Attach To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards. In The Event That The Description Of The Subject Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Ppl Act, This Should Be Understood In Such A Way That They Are Accompanied By The Term Or Equivalent, The Contracting Authority Allows Equivalent Solutions Described In Accordance With Point 1. In The Event That The Description Of The Subject Of The Contract Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Public Procurement Law, The Employer Cannot Reject The Offer Just Because The Offered Deliveries Are Not In Line With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, To Which The Description Of The Subject Of The Contract Applies, Provided That The Contractor Proves In The Offer That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Contract. If The Description Of The Subject Of The Contract Refers To The Requirements For The Efficiency Or Functionality Referred To In Art. 101 Para. 1 Point 1 Of The Public Procurement Law, The Employer May Not Reject The Offer In Accordance With The Polish Norm Transferring The European Standard, The Standards Of Other Member States Of The European Economic Area Transferring European Standards, With European Technical Assessment, With The Common Technical Specification, With The International Standard Or With The Technical Reference System Established By The European Normalization Authority, If These Standards Regarding The Efficiency Or Functionality Specified By The Ordering Party, Provided That The Contractor Proves In The Offer That The Delivery Meets The Performance Or Functionality Requirements Specified By The Employer.
