Wherever The Contracting Authority Describes The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Public Procurement Law, It Is Assumed That Such As Accompanied By The Words Or Equivalent, And The Contracting Authority Allows Equivalent Solutions Described. 5. The Contractor, Who Refers To Equivalent Solutions, Is Obliged To Show That The Solution He Offers Meets The Requirements Set By The Contracting Authority. In This Case, The Contractor Attach To The Offer A List Of Equivalent Solutions With Its Description Or Standards. 6. In The Event That The Description Of The Subject Of The Contract Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Public Procurement Law, The Employer Cannot Reject The Offer Just Because The Offered Deliveries Are Not Consistent With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, To Which The Description Of The Subject Of The Contract Applies, Provided That The Contractor Proves In The Offer That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Contract. 7 In The Event That The Description Of The Subject Of The Contract Refers To The Requirements For The Efficiency Or Functionality Referred To In Art. 101 Para. 1 Point 1 Of The Public Procurement Law, The Employer May Not Reject An Offer In Accordance With The Polish Standard Transferring The European Standard, The Standards Of Other Member States Of The European Economic Area Transferring European Standards, With European Technical Assessment, With The Common Technical Specification, With The International Standard Or With The Technical Reference System Established By The European Normalization Authorization, If These Standards, Technical Assessments, Specifications And Systems Technical References Relate To The Requirements For The Efficiency Or Functionality Specified By The Employer, Provided That The Contractor Proves In The Offer That Delivery Or Service Meet The Requirements For The Performance Or Functionality Specified By The Contracting Authority.
