The Subject Of The Order Is The Delivery Of A Brand New (Unused) Backhoe Loader With Accessories As Part Of The Investment Task Purchase Of Civil Defense Equipment Called Da-Ze-Ze-Ze-Ze-Zej Equipment Or Subject Of The Order In Accordance With The Conditions And Parameters Specified In Annex 8 To Swz-Description Of The Subject Of The Order. 2 The Contractor Is Obliged To Provide The Subject Of The Contract With A Full Fuel Tank, Full Documentation, Including Certificates And Approvals Allowing The Abovementioned Equipment For Proper Use. The Contractor Declares That The Performed Subject Of The Contract Will Be Factory New, Unrebructed And Free From Factory And Legal Defects. 3. The Subject Of The Order Must Be Attached To The User Manual In Polish, With Particular Emphasis On The Requirements Of Ensuring Security. The User Manual Must Be Transferred To The Employer On The Day Of Receipt Of The Equipment In The Paper Version And On A Digital Medium In Pdf.4 Format. A Detailed Description Of The Subject Of The Contract, Warranty And Service Conditions Are Described In Annex 8 To Swz And The Project Provisions. 5. The Contractor Will Notify The Ordering Party About The Date Of Receipt Of The Delivery, At Least 5 Days Before The Date Of Receipt Of The Backhoe Loader. 6. The Contractor In The Price Of The Offer Will Train At Least Two Operators Of The Employer In The Field Of Construction, Service And Service Requirements, Backhoe Loader. 7 Delivery Of The Subject Of The Order Will Take Place At The Cost And Risk Of The Contractor. 8. In The Event Of Indications In Swz Trademarks, Patents Or Origin, As Well As Norms, Technical Approvals And Reference Systems, The Contracting Authority Allows You To Offer Equivalent Solutions In Relation To The Swz Indicated In Swz, Provided That They Guarantee The Implementation Of Delivery In Harmony With Swz And, Ensure Obtaining Technical Parameters Not Worse Than Founded In Swz And Will Be Consistent In Terms Of: 1) Dimensions And Construction (Size, Type, Physical Properties And Number Of Components), 2) Usable Nature (Identity Of The Functions), 3) Material Characteristics (Type And Quality Of Materials), 4) Technical Parameters (Strength, Durability, Technical Data, Linear Characteristics, Constructions, Etc.), 5) Use Of Safety Of Use, 6) Emission Standards, 9. Contractor The Equivalent Described By The Ordering Party Is Obliged To Show That The Materials, Elements And Systems Offered By Him As Part Of The Subject Of The Contract Meet The Requirements Set By The Contracting Authority. 10. Elements Of Equipment (Devices) Must Be Proper Quality Products, Factory New, Complete, Unused, Free From Material, Construction And Legal Defects. 11. The Employer Informs That Pursuant To Art. 310 Point 1) Of The Pzp Act. He Will Annul The Contract For Awarding The Award, If The Public Funds That The Employer Intends To Allocate To Finance All Or Part Of The Contract Will Not Be Granted To Him.
