1. The Subject Of The Contract Is The Construction Of A Construction Work - Renovation Of The Surface Ul. Sejneńska Along The Provincial Road No. 655 And 653 Within The Administrative Boundaries Of The City Of Suwałki (On The Section From Ul. Utrata To The Intersection With Waryńskiego Street). 2. The Detailed Scope Of Works Was Specified In Annex 2 To Swz (Price Form). 3. A Detailed Description Of The Subject Of The Contract And The Scope Of The Contractors Obligations Was Specified In Annex 5 - The Detailed Technical Specification (Hereinafter Sst), In Annex 10 To Swz - A Template Of The Contract And In Annex 11 To Swz - Situational And Highness Plan. 4. Pursuant To Art. 101 Para. 4 Of The Public Procurement Law Act, In A Situation Where The Documents Describing The Subject Of The Contract, Contained A Reference To Standards, European Technical Assessments, Approval, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Public Procurement Law, And Such References Were Not Accompanied By The Or Equivalent Expression, The Contracting Authority Allows Equivalent Solutions Described In Each Such Norm, European Technical Assessment, Approval, Technical Specifications, And Technical Reference System. In Connection With The Above, It Should Be Assumed That Each: Norm, European Technical Assessment, Approval, Technical Specification, Technical Reference System Occurring In The Description Of The Subject Of The Contract Is Accompanied By Or Equivalent Words. 5. Pursuant To Art. 101 Para. 5 Of The Public Procurement Law, The Contractor, Who Refers To Equivalent Solutions Described In These Documents, Is Obliged To Prove By Joining The Relevant Evidence In Question Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Balance Meet The Requirements Set Out In The Description Of The Subject Of The Contract. 6. In The Event That The Description Of The Subject Of The Contract Indicates In Relation To Some Materials Or Devices For Trademarks, Patents Or Origin, Sources Or A Special Process That Characterizes The Product, This Means That They Are Given, For Example And Mean The Minimum Expected Quality Parameters And The Required Standard. 7. The Contracting Authority Will Consider Those That Have Qualitative And Functional Parameters As Materials Or Devices, At Least At The Level Of Parameters Specified In The Description Of The Subject Of The Contract Or Better.
