1) The Subject Of This Order Is Purchase Of A Light Rescue And Firefighting Car For The Tso In Kisielany Żmichach 2) A Detailed Description And Manner Of The Contract Are Contained In: A) Annex 5 To Swz-Description Of The Subject Of The Contract, B) Annex 7 To Swz-Designed Contract Provisions (Template Of The Contract). 3) Wherever The Subject Of The Contract Was Described By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2 And Para. 3 Of The Act, The Ordering Party Allows Equivalent Solutions Described, And Such Reference Is Accompanied By Words Or Equivalent 101 Para. 1 Point 2 And Para. 3 Of The Act, And The Offered Deliveries Are Not In Line With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, To Which The Description Of The Subject Of The Contract Applies, The Contracting Authority Will Not Reject The Offer Provided That The Contractor Proves That The Proposed Solutions Are Equivalent To Equivalently Meet The Requirements Specified In The Description Of The Subject Of The Order. The Functionalities Referred To In Art. 101 Para. 1 Point 1 Of The Act, The Employer Will Not Reject The Offer In Accordance With The Polish Norm Transferring The European Standard, The Standards Of Other Member States Of The European Economic Area Transferring European Standards, With European Technical Assessment, With Common Technical Specification, With The International Standard Or With The Technical Reference System Established By The European Normalization Authority, If These Norms, Technical Assessments, Specifications And Technical References Systems And Systems They Apply To The Requirements For The Efficiency Or Functionality Specified By The Ordering Party, Provided That The Contractor Proves That The Delivery Meets The Requirements For The Performance Or Functionality Specified By The Employer. 6) In The Case Of Description Using Standards, Equivalent Solutions Are Considered To Be Such Solutions That Ensure That The Minimum Requirements Specified In The Standard At The Level Are Not Worse Than Described In Relevant Standards. In The Case Of The Swz, The Current Norms Are Understood In The Other Cases (Description Of The Subject Of The Contract Using European Technical Assessments, Approval, Technical Specifications And Technical Reference Systems), Equivalent Is Such A Product, Material Or System With Technical, Functional And Quality Parameters Not Worse Than Those Mentioned In The Description Of The Subject Of The Contract. 8) If Any Attachment To Swz Would Indicate Materials And Devices Trademarks Or Origin Of The Ordering Party, In Accordance With Art. 99 Para. 4 Of The Pzp Act, Allows The Use Of Equivalent Products.
