3.1 Detailed Description Of The Subject Of The Contract: The Subject Of The Order Is The Construction Of A New Retaining Wall Along With The Demolition Of The Existing Wall Along The Municipal Road Ul. Wygon In Szczawnica. The Contractor Is Made To Conduct A Vision Of The Local Investment Area In Order To Get Acquainted With Local Field Conditions. 3.1.1 The Order Includes In Particular: A) The Demolition Of The Existing Retaining Wall, About 32 Meters Long, Total Height Of About 1.8 Meters, B) Performing A New Retaining Wall About 32 Meters, A Height Of About 1.3 Meters, C) A Set On A New Mand. Resistance Fence With A Height Of About 1.5 Meters. The Designed Retaining Wall Is To Be Made In A Traditional Reinforced Concrete System. 3.2 Determining The Subject And Scope Of The Contract: 3.2.1 Detailed Description Of The Subject Of The Contract And The Scope Of Works Specify: 1) Design Documentation, Which Consists Of: A) Approved By Decision No. 131/2024 On Approval Of The Land Development Project And The Architectural And Construction Design And Architectural Granting A Building Permit Of 16.02.2024. Land Development Project And Architectural And Construction Design, B) Technical Design2) Technical Specifications For The Implementation And Acceptance Of Construction Works. 3.2.2 The Bill Of Quantities Attached To Swz Is An Auxiliary Material And Is Not Binding On The Parties-It Does Not Constitute A Description Of The Subject Of The Contract. The Lack Of Works Necessary For The Performance Of The Contract In Order To Perform Proper Performance Does Not Entitle The Contractor To Claim The Employer To Increase The Remuneration Due. 3.2.3 The Ordering Party Does Not Specify, In Relation To Contractors Jointly Applying For The Contract, The Requirements Related To The Contract, Referred To In Article 58 (4) Of The Act. 3.2.4 If Trademarks, Patents, Norms Or Origin Appear In The Order Documents, Should Be Understood As Examples And Considered Together With The Word Equivalent. 3.2.5 In The Event Of Describing The Subject Of The Contract By Means Of Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Article 101 (1-2-3 Of The Act, The Employer Allows Equivalent Solutions. The Contractor, Who Refers To Equivalent Solutions, Is Obliged To Prove In The Offer, In Particular By Means Of The Means Of Evidence Referred To In Article 104-107 Of The Act, That The Proposed Solutions To An Equivalent Extent Meet The Requirements Set Out In The Description Of The Subject Of The Contract.
