1. The Subject Of The Contract Is The Implementation Of The Investment Task Entitled Retrofitting In The Air Conditioning Installation Of The Public Kindergarten Building No. 1 In Marki, Ul. Okólna 34. 2. The Detailed Scope Of Construction Works Being The Subject Of This Contract Is Determined By The Design Documentation, I.E. Technical And Performance Design And A Bill Of Quantities, Constituting Annex 1 To Swz And The Contract Template Constituting Annex 2 To Swz.3. Subject To The Exceptions Clearly Indicated In The Template Of The Contract Constituting Annex 2 To Swz, Regardless Of The Special Circumstances, The Gross Flat -Rate Remuneration Referred To Above May Not Be Increased Throughout The Entire Period Of Performance Of The Subject Of The Contract. However, The Above Does Not Exclude The Possibility Of Increasing The Contractors Remuneration Provided For In Art. 632 § 2 Of The Civil Code. 4. The Amount Of Remuneration Must Be Gross Contains The Costs Of All Works Necessary For The Proper Performance Of The Subject Of The Contract Resulting Directly Or Indirectly From Project Documentation Or Technical Knowledge, As Well As The Costs Of All Works Necessary For The Proper Performance Of The Subject Of The Contract, And In Particular The Costs Of All Preparatory, Order Works, Development Of The Construction Site, The Costs Of Securing The Construction Site, As Well As The Costs Of All Necessary Tests, Trials, Technical Acceptance And Insurance Contractors, As Well As Conducting Through The Entire Warranty Period: Service And Inspections Needed For Proper Operation Of Built -In Devices, Installations, Technology And Equipment Elements, With Frequency At Least Once A Year. 5. The Amount Of Gross Remuneration Must Include The Contractors Risk And Liability For Checking The Contract Together With Its Attachments, Taking Into Account Any Inaccuracies, Contradictions Or Incompleteness. The Contractor Is Obliged To Perform As Part Of A Lump Sum Gross Remuneration Specified In The Contract All Works Necessary To Implement The Subject Of The Contract.
