1. The Subject Of The Order Is The Creation Of A Support Center Of The Care And Residential Center Based In Tuchomie. The Order Of The Order Includes, Among Others Construction Of A Building And Residential Care Center With Land Development In Tuchom. The Order Of The Order Includes The Implementation In The Formula Design And Build As Described In The Functional And Utility Program And Includes The Design And Execution Of Construction Works In The Above-Mentioned Scope. The Detailed Scope For Works Is Described In The Pfu Functional And Utility Program (Attachment To Swz No. 4), Except That The Contracting Authority Allows Equivalent Solutions Described In The Above-Mentioned Documentation. Before Starting The Works, The Contractor Will Also Notify Interested Institutions And Owners Of Underground Weapons About The Start Of Construction (If Concerned). In The Case Of Earthworks In A Very Close Proximity Of Buildings, Special Caution Should Be Exercised And The Provisions Of The Construction Law Absolutely Should Be Exercised. The Contractor Undertakes To Perform The Subject Of The Contract In Accordance With The Documentation, Principles Of Technical Knowledge And Building Art, Applicable Regulations And Polish Norms, On The Conditions Indicated In The Contract And Swz. The Materials Adopted In The Functional And Utility Program Guarantee The Achievement Of The Assumed Effect. In The Case Of Use In The Documentation Describing The Subject Of The Order Of References To The Standards, European Technical Assessments, Approval, Technical Specifications And Technical Reference Systems, The Contracting Authority Allows Equivalent Solutions Described. When Analyzing The Documentation, The Contractor Should Assume That Each Reference Used In The Documentation Is Accompanied By A Or Equivalent Word. In The Event That Trademarks, Patents Or The Origin Of Products/Source/Special Process That Could Characterize Products Or Services Provided By A Specific Contractor, Means That They Are Given, For Example And Specify The Minimum Expected Quality Parameters And The Required Standard, It Means That In The Documentation. The Contractor May Apply Equivalent Materials Or Devices, But With Technical And Quality Parameters Similar Or Better, Which Will In No Way Negatively Affect The Proper Functioning Of The Solutions Adopted In The Documentation. The Contractor Who Uses Devices Or Equivalent Will Be Obliged To Show During The Performance Of The Order That The Devices And Materials He Used Meet The Requirements Set By The Employer. Pursuant To Art. 101 Para. 4 Of The Public Procurement Law Act, The Contractor Using Equivalent Materials Undertakes To Use Materials With Parameters Not Worse Than Those Specified In The Documentation. If The Employer Allows Equivalent Solutions Described In The Documentation, But Does Not Provide Minimum Parameters That This Equivalence Confirmed The Contractor Is Obliged To Offer A Product With Similar Properties, Which Is Functional
