The Public Procurement Is Related To The Provision Of Services For The Provision Of Copyright Supervision In The Implementation Of Construction, In Accordance With The Requirements Of Art. 162 Of The Spatial Planning Act, In Order To Ensure The Successful Implementation Of The Draft And Signing Acts And Protocols By The Designer / Tvs For The Implementation Of Construction, In Accordance With The Requirements Of Ordinance No. 3 / 31.07.2003 On The Preparation Of Acts And Protocols During The Construction And Ordinance № 2 / 31.07.2003 For The Commissioning Of The Construction Works Installation Works, Facility And Construction Sites. The Exercise Of Copyright Supervision Aims To Observe The Processes Of Construction Activities, To Ensure Compliance With The Parameters Of The Investment Projects, As Well As To Give Instructions During Implementation And Decisions In The Event Of Unforeseen Circumstances In The Implementation Of The Project. Copyright Supervision Should Be Implemented In Accordance With The Provisions Of The Spa And Other Relevant Regulations Governing The Activity Performed. According To Art. 162, Para. 2 Of The Spatial Planning Act, The Terms And Procedure For Carrying Out Copyright Supervision During Construction Shall Be Determined Through A Contract Between The Contracting Authority And The Designer, For This Purpose The Contract For The Implementation Of Copyright Supervision Is Bound By The Functions To Be Performed By The Same Natural Persons Who Have Prepared The Project. According To Art. 3, Para. 1, Item 8 Of The Copyright And Related Rights Act (Lapsp) Approved Architectural Projects, Approved Planning Projects, Maps, Schemes, Plans And Others Concerning Architecture, Territorial Structure And Any Area Of ​​Science And Technology Are The Subject Of Copyright, And This Right Arises For The Author. According To Art. 162, Para. 2 Of The Spatial Planning Act The Conditions And The Procedure For Exercising Copyright Supervision During Construction Shall Be Determined By A Contract Between The Contracting Authority And The Designer. According To Art. 162, Para. 3 Of The Same Law, The Prescriptions Of The Designer Related To His Copyright, For The Accurate Compliance With The Investment Project He Worked Out By Him Are Entered In The Order Book And Are Binding On The Other Participants In The Construction. In This Sense, The Contracting Authority Is Obliged To Commission The Authors Supervision To The Person Who Has Carried Out The Design. The Assignment Of Copyright Supervision Of Persons Other Than The Designers Would Lead To A Copyright Violation Under Art. 3, Para. 1, Item 8, Para. 3, Art. 18, Para. 1 And Para. 2, Item 9 Of The Law On The Law On The Law And Until The Failure Of Obligations Under Art. 162 Of The Spatial Planning Act, Which Necessitates The Award Of The Public Procurement Under The Procedure Of Art. 191, Para 1, Item 2 Of The Public Procurement Act.
