1. The Subject Of The Order Are Construction Works Involving The Modernization Of The Bar In Building C At Ul. Śniadeckich 2 In Koszalin To The Extent Specified In The Swz And Project Documentation Constituting Annex 10 To Swz, Which Includes: Technical Specification Of Construction And Acceptance Of Construction Works (Hereinafter Referred To As Stwiorb), Failure Of Works And Interior Design Project. 2. The Employer Does Not Allow Partial Offers. Division Of The Order Into Tasks Would Threaten Excessive Technical Difficulties And The Costs Of Performing The Contract, As Well As The Need To Coordinate The Activities Of Various Contractors Carrying Out Individual Parts Of The Order. In Addition, There Would Be A Risk Of Non -Performance Of Part Of The Order. The Subject Of The Contract Is Adapted To The Implementation By Small And Medium Entities. 3. A Detailed Description Of The Subject Of The Contract Is Included In Annex 1 To Swz And Design Documentation Constituting Annex 10 To Swz.4. The Contractor Is Obliged To Grant A Warranty On The Subject Of The Contract, Including The Works Performed By Subcontractors For A Period Of At Least 36 Months (Counting From The Date Of Signing The Final Receipt Of The Subject Of The Contract Without Reservations By Both Parties). For Installed Devices And Equipment: Manufacturers Warranty, I.E. 24 Months. 5. In Cases Where The Description Of The Subject Of The Contract Indicates Standards, Trademarks, Patents Or Origin, Sources Or A Special Process That Characterizes The Products Supplied By A Specific Contractor, Which Means That The Contracting Authority Cannot Describe The Subject Of The Order In A Sufficiently Precise And Understandable Way. In Such Situations, Possible Indications Of Norms, Trademarks, Patents, Origin, Source Or Special Process Should Be Read With Or Equivalent Words. If The Contracting Authority Has Indicated Brands Or Trade Names, It Defines The Product Class, Which Is The Subject Of The Contract And Serves To Determine The Standard, And Does Not Indicate A Specific Product Or Manufacturer. The Employer Indicates The Criteria Used To Assess The Equivalence: As Equivalent To The Subject Of The Contract, The Employer Will Consider Products That Meet The Minimum Quality, Operational And Technical Requirements Corresponding To The Requirements Indicated In The Description Of The Subject Of The Contract. 6. Whenever In The Swz Content Or In Attachments, The Employer Refers To Any Standards, Approvals Or Certificates, The Contractor May Use Standards, Approvals Or Certificates In Relation To Them Equivalent. Demonstrating Equivalence, I.E. Meeting The Requirements Specified By The Employer In Swz, Lies With The Contractor. The Contractor Is Obliged To Indicate In The Offer What Standards Have Been Converted And State What They Propose In Their Place, Providing Their Description And Parameters.
