1. The Subject Of The Contract Is The Implementation Of Project Documentation And Based On Its Basis For Construction Works For The Task Entitled Garden Of Senses, Games And Ideas In The City Kindergarten No. 20 In Bytom, Including The Modernization Of The Playground. The Subject Of The Order Will Therefore Be Carried Out In The Design-Budy System. 2. The Subject Of The Contract Includes: 1) The Implementation Of Technical Documentation, I.E. A Construction Project Together With The Necessary Arrangements, Opinions Regarding The Modernization Of The Playground In The City Kindergarten No. 20 In Bytom; 2) Execution Of Construction Works, The Subject Of Which Is The Modernization Of The Playground In The City Kindergarten No. 20 In Bytom. The Setting Description Of The Subject Of The Contract Contains A Functional And Use Program, Which Is An Attachment To Swz.3. The Contractor Is Obliged To Grant The Employer A 60 -Month Warranty And Warranty For The Subject Of The Contract, Calculated From The Day Of Final Acceptance Of Construction Works. The Contractor May Offer A Longer Warranty And Warranty Period, Which Will Be Assessed As Part Of The Offer Evaluation Criteria (See: Part Xviii Swz). 4. The Contractor Is Obliged To Employ On The Basis Of An Employment Relationship Within The Meaning Of The Labor Code - All Persons Performing Construction Works Such As Dismantling, General Construction, Assembly And Other General Construction Works Listed In The Precipitate Prepared By The Contractor As Part Of The Subject Of The Contract, For Which The Rights Are Not Required. Above The Obligation Does Not Apply To Entrepreneurs Personally Performing Any Of The Abovementioned Works, Cooperating Persons Within The Meaning Of The Act Of 13 October 1998 On The Social Insurance System, As Well As The Incumbent Members Of The Managing Or Supervisory Authorities Of The Contractor, Partners Of A General Partnership Or Partner Company To The Extent That They Will Personally Perform The Service To The Contracting Authority Or Contractor. The Above Is Used According To Subcontractors. Determining The Method Of Documenting Employment Of These Persons, The Contracting Authoritys Rights In The Scope Of Compliance And Sanctions For Failure To Meet These Requirements Were Specified In The Proposed Contractual Provisions. 5. The Purchaser Does Not Reserve The Obligation To Perform A Key Part Of The Contract By The Contractor In Person. The Contractor May Entrust The Performance Of Part Of The Subcontractors Order. The Contractor Should Indicate In The Offer Part Of The Contract, Which He Intends To Entrust To Subcontractors And Provide The Names Of Possible Subcontractors If They Are Already Known. Entrusting The Performance Of Part Of The Order To Subcontractors Does Not Release The Contractor From Liability For The Proper Performance Of This Order. 6.
