In The Scope Of The Subject Of The Contract, The Following Works Will Be Carried Out: 1) Stage I - Development Of Project Documentation Based On A Functional And Utility Program (Pfu) And Obtaining All Necessary Opinions, Arrangements And Administrative Decisions, Entitling To Start And Carry Out Construction Works, 2) Stage Ii - Implementation Of Construction Works, Based On The Developed Project Documentation, Referred To Above. 3. The Detailed Scope Of The Description Of The Subject Of The Contract Is A Functional And Utility Program Constituting An Attachment To Swz.4. If In The Swz, Advertisements Related To The Procedure, In A Detailed Description Of The Subject Of The Contract, The Subject Of The Contract Was Determined By Indicating Trademarks, Patents Or Origin, Source Or A Special Process That Characterizes The Products Or Services Provided By A Specific Contractor, This Is Only Intended To Determine The Technical Features Or The Properties Of A Specific Equipment, Devices And Materials To Be Used To Perform The Subject Of The Contract. The Employer Allows The Use Of Equipment, Equipment And Equivalent Materials In Such Cases, In Accordance With Art. 99 Para. 5 Of The Act. 5. The Warranty Period For Project Documentation Is 36 Months. 6. The Warranty Period For Construction Works Being The Subject Of The Contract And For Materials Provided And Built By The Contractor Is A Minimum Of 36 Months From The Date Of The Final Receipt Of The Non -Abuse Or Date Of Removal Of Defects/Defects Found During Receipt. 7. Proposing In The Offer To Grant A Warranty For Construction Works Longer Than 36 Months Will Be Additionally Scored In Accordance With The Registration Of Chapter Xxiv. Description Of The Criteria For Assessing Offers, As The Scale Of These Criteria And The Method Of Evaluation Of Offers. Proposing A Guarantee Of Less Than 36 Months In The Offer Will Be The Basis For Rejecting The Offer. 8. The Contractor Will Grant A 12-Month Warranty For Project Documentation And A Warranty Corresponding To The Warranty Period For Construction Works. 9. Pursuant To Art. 95 Para. 1 Of The Pzp Act, In Order To Ensure The Correct Performance Of The Subject Of The Contract, The Contracting Authority Requires Employment By The Contractor Or Subcontractor On The Basis Of An Employment Contract, For The Period Of The Contract, All Persons Performing Activities Indicated By The Contracting Authority In The Scope Of The Contract, Which Will Perform Activities Actually Related To The Subject Of The Contract, I.E. - Driver Of Trucks And Delivery Cars, - Excavator Operator - Charger, - Paving. 10. Implementation Of The Activities Listed In Para. 5 Consists Of Performing Work In The Manner Specified In Art. 22 Of The Act Of 26 June 1974 Labor Code (Journal Of Laws Of 2023, Item 1465). The Above Requirement Does Not Apply To The Contractor Or Subcontractor (Including Partners Of Partnerships), Who Will Personally Implement The Above -Mentioned Activities On
