The Goods Must Be Delivered In The Original Factory Packaging, With Security Used By The Manufacturer. The Packaging Must Allow Full Identification Of The Goods, E.G. Quantity, Type, Parameters, Expiry Date, Etc. - Without Having To Violate The Packaging. The Contracting Authority Does Not Set Requirements As To The Type Of Packaging (Returnable Or Non -Returnable) In Which The Subject Of The Contract Is To Be Delivered, While Informing That In The Case Of Returnable Packaging All Costs Of Their Application Are Borne By The Contractor. The Contractor Will Be Required To Attach A Quality/Approval Certificate Or Other Document Confirming The Possession Of The Quality Assurance System To Each Delivery. Documents Confirming Product Compliance With Qualitative Requirements, Such As Quality Certificates, Laboratory Test Reports, Quality System Certificates (E.G. Iso 9001). 4.3. Placing An Offer For The Subject Of The Contract Not Meeting All Parameters Or Having Parameters Worse Than The Required Will Result In Rejection Of The Offer. 4.4. In The Case Of Describing The Subject Of The Contract By Indicating Trademarks, Patents Or Origin, Source Or A Special Process That Characterizes The Products Provided By A Specific Contractor, The Contracting Authority Allows The Possibility Of Submitting Equivalent Offers. The Equivalent Offer Is An Item With The Same Or Better Technical, Quality, Functional Parameters That Meet The Minimum Parameters Specified By The Contracting Authority In The Description Of The Subject Of The Contract. 4.5. Pursuant To Art. 139 Of The Act, The Employer Will First Examine And Evaluate The Offers, And Then Perform The Subjective Qualification Of The Contractor, Whose Offer Will Be The Highest Rated, In The Scope Of The Lack Of Grounds For Exclusion And Meeting The Conditions For Participation In The Proceedings. 4.6. If The Contractor Referred To In Point 4.5, There Are Grounds For Exclusion, This Contractor Does Not Meet The Conditions For Participation In The Procedure, Does Not Submit Subjective Means Of Evidence Or The Statement Referred To In Art. 125 Para. 1 Of The Act, Confirming The Lack Of Grounds For Exclusion Or Fulfillment Of The Conditions For Participation In The Procedure, The Employer Will Re -Examine And Evaluate The Offers Of Other Contractors, And Then Perform The Subjective Qualification Of The Contractor, Whose Offer Has Been The Highest Assessed, In The Scope Of The Lack Of Grounds For Exclusion And Complying The Conditions For Participation In The Proceedings. 4.7. The Employer Will Continue The Procedure For Re -Examining And Evaluating The Offers Referred To In Point 4.6, In Relation To The Offers Of Contractors Remaining In The Proceedings, And Then Perform The Subjective Qualification Of The Contractor, Whose Zos Offer
