5.1 The Subject Of The Contract Are Trainings For Employees Of The Municipal Office In Andrychów. Description Of The Subject Of The Order Was Included In Annex 3 To Swz. 5.2 In The Event Of Balance Materials Of Unambiguous Patents, Trademarks, Materials, Products Or Devices Indicating The Manufacturer And Specific Catalog Types - All Such Names Should Be Read With A Or Equivalent Clause Each Time With The Same Or Not Worse Technical, Quality, Functional And Aesthetic Parameters. If Specific Types Of Materials, Products And Devices Are Given In The Above Documents, This Should Be Treated As An Auxiliary Indication Of The Minimum Quality Level (Standard). The Employer Allows The Offering Of Equivalent Materials And Devices, Provided That They Guarantee Obtaining Quality Parameters And Functional Features At Least At The Level Of The Indicated Product. In Such A Situation, The Employer Requires The Submission Of Relevant Documents To Make These Materials Or Devices To Prove That The Quality Parameters And Utility Features Offered Are Balanced Or Better Than Submitted In The Documentation. Providing That The Materials, Items Or Goods Used Have Parameters Equal Or Better Than Materials, Items Or Goods Established In The Description Of The Subject Of The Contract Rests With The Contractor. The Costs Related To Demonstrating The Equivalence Of Solutions Are Borne By The Contractor. The Contractor Submitting An Equivalent Offer Bears Full Responsibility For The Proper Functioning Of Technical Solutions. 5.3 The Ordering Party Does Not Divide The Order Into Parts. Reasons Of Failure To Divide: Dividing The Order Into Parts Would Not Increase The Involvement Of Contractors From The Sme Sector, And Would Not Increase Competitiveness In The Proceedings. 5.4 The Offer Must Include The Entire Order. The Contracting Authority Does Not Allow Partial Offers. 5.5 The Order Is Part Of The Order Entitled: Improving Cybersecurity At The Municipal Office In Andrychów As Part Of The Cyber -Secured Local Government Grant Project. 5.6 The Ordering Party Does Not Provide For The Requirement To Employ Persons Under An Employment Contract. Pursuant To Art. 95 Paragraph 1 Of The Public Procurement Law, The Employer Informs That In The Scope Of The Contract There Are No Activities Whose Performance Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of 26 June 1974 - Labor Code (Journal Of Laws Of 2025, Item 277, As Amended).
