12 The Contracting Authority Reserves The Right To Order A Smaller Amount Of Diesel Depending On The Current Needs, With The Right To Reduce The Value Of The Contract, Without The Contractors Right To Make Claims In This Respect. The Minimum Amount Of Diesel Will Be 20M 3.3. The Subject Of The Contract Must Correspond To The Parameters In Accordance With The Quality Characteristics Required By The Polish Standard On /Pn-En 590+A1: 2017-06 /Ap2: 2018-09, I.E. Be Intended For Use In Automotive Motor Type Engines (Diesel) .4. 4. The Oil Must Be An Original Product, I.E. It Should Be Produced By The Manufacturer Who Owns The Recipe And Symbol, Name And Trademark Used For Its Designation. 5. If The Contracting Authority Finds That The Poor Quality Of Diesel Was The Cause Of The Failure Or Destruction Of The Vehicles Parts Or Equipment - The Contractor Will Be Obliged To Cover The Losses That The Contracting Authority Will Bear In This Respect. In This Case, The Following Procedure Will Be Carried Out: The Employer Will Take A Fuel Sample From The Vehicle Or Equipment For Examination In The Presence Of A Contractors Representative, Obliged To Immediately Appear At The Place Of Sampling After Prior Telephone Or A Written Notification Of The Collection. The Samples Taken Will Be Secured In A Manner Agreed By The Parties (Sealed, Secured With Tape With Signatures And Stamps Of The Pages, Etc.), And Then In A Manner Agreed By Pages Sent Or Transported To The Laboratory Within Not More Than 3 Business Days From The Day They Were Downloaded. If The Contractors Representative Does Not Appear At The Sample Collection Site, It Is Considered That The Contractor Agrees To Take The Samples Without His Presence And Thus That He Does Not Question The Correctness Of Their Consumption And Does Not Question The Identity Of The Material Put Into The Examination, With The One That Was Taken. If The Results Of The Tests Show That Diesel Oil Does Not Meet The Requirements Specified In The Law, The Costs Of Their Performance Will Be Borne By The Contractor, Otherwise The Costs Will Be Borne By The Contracting Authority. If It Is Found That Diesel Oil Does Not Meet The Requirements Set Out In The Law Of The Contractor Will Be Obliged To Cover The Losses That The Employer Has Suffered From Failures Or Destruction Of Parts, Devices, To Which The Contracting Authority Will Present The Appropriate Photocopies Of Accounting Documents. In Order To Confirm The Supply By The Contractor With The Adequate Fuel Quality For Vehicles And Equipment Of The Contracting Authority, The Contracting Authority Has The Right To Consider Diesel Oil Samples At Any Time Of The Contract In The Presence Of The Contractor. 6.
