1. The Subject Of The Order Are Construction Works Entitled: Reconstruction Of Municipal Road No. 205036N Ul. Reja In Giżycko, Plot No. 99, Precinct 0001 City Of Giżycko. 2. The Basic Scope Of Works Includes, In Particular: A) Earthworks, Preparatory And Accompanying Works, B) Renovation Of The Surface, C) Renovation Of The Roadsides, D) Replacement Of Lighting Fixtures For Ledle Luminaires) Renovation Of Exits To Adjacent Real Estate, F) Finishing And Accompanying Works. Delivery Description Of The Subject Of The Contract Contains Design Documentation And Stwiorb, Constituting Annex 9 To Swz. 3. The Employer Requires Special Caution In Conducting Works, In Particular To Ensure Adequate Security And Covers, Maintaining The Construction Site In Good Order, Organizing Construction Works In A Way That Does Not Use People Using A Given And Neighboring Real Estate With The Scope Of The Investment Task. In Connection With The Above, The Contractor Must Take Into Account The Costs Of Securing Works In The Price Of The Offer. This Cost Should Be Included In Indirect Costs. 4. Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law, Requires Employment By The Contractor Or Subcontractor On The Basis Of An Employment Relationship, Persons Performing Activities In The Scope Of The Performance Of The Contract, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974, Labor Code (I.E., Journal Of Laws Of 2025, Item 277, As Amended), The Above Employment Requirement Based On The Employment Relationship Applies To Manual Workers Who Directly Perform Construction Works Covered By The Subject Of The Contract In The Scope Of: A) Demolition And Earthworks, B) Road Works (Roadway, Exits) C) Development Of The Area, D) Electricity., E) Support For Machines, Vehicles, Equipment And Devices. The Above Requirement Does Not Apply To People Performing Free Competitions, Including Designers, Construction Managers And Work Managers. 5. The Contractor Is Obliged To Submit A List Of These Persons Until The Signing Of The Contract Together With A Statement Confirming Employment Under A Contract, As Well As At The Request Of The Employer, Evidence Indicating Their Employment Under A Contract Of Employment.
