Z O.O., Whose Detailed Description, As Well As The Quantitative And Assortment Range Is Specified In The Assortment And Price Form, Constituting Annex 1 To Swz. 2. The Amounts Given In Annex 1 To Swz Should Be Treated As Estimated Needs During The Order, To Determine The Price Of The Offer, I.E. Determining The Estimated Remuneration Of The Contractor. The Contracting Authority Reserves The Right To Give Up The Purchase Of Part Of The Range. The Purchase Of Each Assortment Will Depend On The Actual Needs Of The Employer (Current Patient Condition And Medical Justification). The Demand For Individual Assortment Positions Is Strictly Dependent On The Occupancy Of Individual Hospital Wards And The Type Of Its Patients. 3. The Purchaser Reserves The Right To Change The Amount Of The Ordered Assortment Between Individual Items Of The Subject Of The Contract In The Package. 4. Offered By The Contractor: • The Goods Must Meet The Requirements Specified By The Ordering Party In The Specification Of The Terms Of The Contract, Including The Conditions Set Out In The Assortment And Price Form - Annex 1 Swz; • Be New, Not Used Due Quality, Free From Any Physical Defects, Legal Defects And Claims Of Third Parties, And Meet All Requirements Under Polish Law, In Particular Specified In The Act On Medical Devices (I.E. Journal Of Laws 2024 Item 1620, As Amended), Regulation Of The European Parliament And Of The Council (Eu) 2017/745 Of 5.04.2017 On Medical Facilities, In Terms Of Quality And Admission To Trading In The Territory Of The Republic Of Poland, • The Goods Had A Minimum Expiration Date - Not Shorter Than ¾ Of The Nominal Period Of Validity Of The Manufacturer. • The Subject Of The Contract (Unit And Collective Packaging) Should Be Provided With A Trade Label Prepared In Polish, Containing The Necessary Information Needed For Safe Use, In Accordance With Applicable Regulations In This Respect. If The Original Documentation Is Made In A Different Language, The Contractor Will Provide A Translation Into Polish Along With The Original. • The Goods Must Correspond To The Quality And Technical Standards Resulting From The Functions And Purpose, - To Which The Contractor Has All Current Documents, Which At Any Time At The Request Of The Ordering Party Will Submit For Inspection. The Contractor Bears Full Responsibility For Any Damage Arising From The Employer Or Third Parties In Connection With The Use Of The Goods Provided By The Contractor That Does Not Meet The Requirements. 5.
