In Order To Implement The Application For Financing Related To The Project Entitled “Digitalization Saj Hunedoara Submitted Within The Pnrr, The Contracting Authority Initiated This Public Procurement Procedure, The Details Related To The Products And Services To Be Contracted In The Specifications, An Integral Part Of The Award Documentation. Pnrr/2022/C7/Ms/13 Fact For Which To Make The Contracting Process More Efficient, This Public Procurement Procedure Is Initiated Under The Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditioned By The Allocation Of The Budget Credits With This Destination, (By Obtaining A Financing) The Signing Of The Contract, Which Is To The Contract, Which Is To Be Observed. The Incidence Of The Legislation On Public Finances. Considering The Provisions Of Law 98/2016 On Public Procurement And H.G. No. 395/2016, With The Subsequent Modifications And Completions, The Contracting Authority Specifies That It Will Conclude The Contract With The Bidder/Declared It/I Only To The Extent That The Necessary Funds Will Be Provided By Allocating The Budget Credits With This Destination. If, For Whatever Reasons, The Budget Credits Will Not Be Allocated By Pnrr/Another Internal/International Source, The Contracting Authority, After Receiving The Notification Regarding The Non -Granting, Reserves The Right To Cancel The Award Procedure, Under The Conditions That There Is No Other Source Of Financing, In Accordance With The Provisions Of Art. Subsequent Changes And Completions, Being Impossible To Conclude The Public Procurement Contract, But Not Later Than 6 Months From The Date Of Completion Of The Public Procurement Procedure. The Bidders Within This Procedure Accept The Use Of The Special Conditions Above, Assuming Their Entire Responsibility In Relation To The Possible Damages They Could Suffer In The Situation Described. We Specify That The Delivery Time Of Each Product Is Mentioned In The Specifications In The Section Related To The Technical Parameters While The Validity Period Of The Contract Is Between The Date Of Signing The Contract And The Date On Which All The Contractual Obligations Of The Parties Are Extinguished, So Until The Expiration Of The Guarantee Granted By The Products By The Supplier.
