1. The Subject Of The Contract Is The Investor Supervision Service Over The Task Of Reconstruction And Expansion Of The Urban Mechanical-Biological Sewage Treatment Plant In Sztum. The Order Includes Exercising Investor Supervision Over Construction Works Specified In The Attached Project Documentation And Cooperation With The Employer In Order To Effectively Enforce The Implementation Of These Works From The Contractor. Investors Supervision Also Includes A Control Of The Compliance Of Work With The Requirements Of The Employer And Project Documentation, Ensuring Adequate Quality Of Materials And Technology, Settlement Of Works On The Basis Of Contractual Costs Of Their Implementation And Supervision Over The Timely Performance Of Works, In Accordance With The Terms Of The Contract. 2. Investors Supervision Includes Supervising Construction Works Specified In The Proceedings Number: Zp.2.2024, Called Reconstruction And Extension Of The Urban Mechanical And Biological Sewage Treatment Plant In Sztum. Design Documentation Regarding The Performance Of Construction Works And The Specification Of The Terms Of The Contract (Swz) Together With The Contract Template Are Available On The Website: Https://Platformazakupowa.Pl/Transakcja/979609. 3. The Detailed Scope Of The Contractors Obligations, Which Is The Subject Of The Contract, Was Specified In Annex 5 To Swz - The Proposed Provisions Of The Contract. 4. The Contractor Selected In The Proceedings Will Be Responsible For Performing The Function Of A Supervision Inspector In Accordance With Art. 25 And 26 Of The Construction Law, Applicable Standards And Provisions Of Polish Law, As Well As Technical Documentation And Stwiorb. His Duties Will Also Include Supervision Over The Reports And The Implementation Of Administrative Decisions And Permits. In Addition, The Contractor Will Be Obliged To Carry Out Other Activities Specified In The Planned Provisions Of The Contract, As Well As To Support The Employer In All Technical, Administrative And Financial Activities Related To The Implementation Of The Task. 5. Pursuant To Art. 95 Para. 1 Of The Act, The Contracting Authority Does Not Require That Persons Performing Activities In The Scope Of The Contract, Consisting In Direct Physical Provision Of Services, Were Employed By The Contractor Or Subcontractor Under An Employment Contract Within The Meaning Of Art. 22 § 1 Of The Act Of 26 June 1974 - Labor Code. 6. The Task Is Co-Financed Under The European Funds Program For Infrastructure, Climate, Environment 2021-2027, Operation Fenx.01.03 Water And Sewage Management, Priority Fenx.01 Support For Energy And Environment Sectors From The Cohesion Fund.
