1. The Subject Of The Order Are Aggregate Supplies For The Purposes Of Current Renovations Of The Filipów Commune, Including: 1) Road Gravel With A Grain Of 0-31.5 Mm In An Amount Of About 300 Tonnes, 2) Aggregate 0-31.5 Mm Plus 30% Broken Aggregate In An Amount Of About 375 Tons, 3) Aggregate 0-31.5 Mm Plus 50% Broken Aggregate In An Amount Of About 3 850 Tons, 4) 100% Broken - In An Amount Of About 100 Tons, 5) Sand 0-2 Mm In An Amount Of About 100 Tons, 2. The Amounts Of Materials Given Are Estimated And May Decrease Or Increase During The Contract. The Reduction Or Increase In The Amount Of The Subject Of The Contract Does Not Cause Any Legal And Financial Consequences For The Employer And Does Not Require A Change In The Contract. 3 The Contractor Should Have Such A License Himself Or Have An Appropriate Contract With The Owner Of Such A License, Which Will Show That The Contractor Will Have The Right To Extract The Material For Which The Mining License Was Issued. The Supplied Aggregate Must Have Approvals Required By Law, Certificates, Quality Certificates Corresponding To Pn-En 13242, Pn-En 13043: 2004 Or Equivalent. The Contractor For The Material Provided In Invoices And Delivery Evidence Wz Is Obliged To Submit Declarations Of Compliance Confirmed By The Manufacturer (Mines). 4. The Employer During The Delivery Of Aggregate Allows His Samples To Take The Laboratory Tests Of Its Technical Properties In The Event Of Parameters That Are Not In Line With The Declared, The Contractor Will Replace The Built -In Aggregate At His Own Expense. Aggregate Should Be Clean, Unwanted Adverse Materials Such As Metal, Plastic, Wooden, Clay Waste: In The Event Of A Fraud In The Content Of The Aforementioned Pollutants, The Contracting Authority Will Refuse To Accept The Delivery. The Employer Allows The Possibility Of Checking The Actual Weight Of The Supplied Material During The Implementation Of The Order. In The Event Of A Non -Compliance Between The Declared Weight Of The Material Supplied By The Contractor And The Real Weight, The Contractor Shall Bear All Costs Related To The Weighing Of The Vehicle In Order To Ensure Real Data Regarding The Supplied Material Enabling The Settlement Of The Order. In This Case, The Ordering Party Is Entitled To Immediately Withdraw From The Contract Due To The Contractor And Calculate The Contractual Penalties In Accordance With §5 Of The Contract. 5. The Scope Of The Order Includes The Purchase, Along With Loading, Transport, Unloading Of Aggregate, Which Will Be Commissioned By The Contractors Successively According To The Individual Needs Of The Ordering Party During The Period Of The Contract. The Municipal Path Requiring Gravel Is Determined By The Contracting Authority In A Single Order (Application). The Contractor Will Start Delivering No Later Than Within 4 Business Days Of The Submitted Application Or Telephone Order. 6. Due To The Fact That The Transport Of Aggregates Will Take Place On Unpaved Roads, W
