The Subject Of The Order Is The Acceptance And Management Of Waste Resulting From The Services Provided By The Company In The Field Of Waste Collection (Estimated Weight 550 Mg). The Order Covers The Management Of Mixed Waste From Construction, Renovation And Dismantling Other Than Those Mentioned In 17 09 01, 17 09 02 And 17 09 03 (Waste Code - 17 09 04). Waste Management Should Be Understood In Particular As Segregation (Sorting) In The Processing Process Taking Into Account The Provisions Of Art. 101A Section 1 Of The Waste Act, As Well As Further Management Of Waste Resulting From This Segregation (Sorting) In Processes Ensuring Their Reuse (For Each Of The Separated Fractions Of Wood, Metal, Glass, Plastics, Plaster, Mineral Waste, Including Concrete, Brick, Tiles, Ceramic Materials And Stones). Further Waste Management May Be Carried Out Independently By The Contractor, Segregated Waste Fractions May Also Be Directed To Entities (Further Waste Holders) Having The Permits Required For Further Processing Of These Fractions In Recycling And Recovery Processes, In Accordance With The Waste Hierarchy (Article 18 Of The Act On Waste). The Subject Of The Order Will Be Implemented In Accordance With The Provisions Of The Environmental Protection Act (Consolidated Text: Journal Of Laws Of 2024, Item 54, As Amended), The Waste Act (Consolidated Text: Journal Of Laws Of 2023, Item 1587, As Amended). ), Provisions Of The Current Waste Management Plan For The Małopolska Voivodeship, Local Legal Acts Regulating Waste Management And Acts Amending Or Replacing Them, And Decisions Held By The Contractor. The Waste Will Come Exclusively From The Polish Market (Domestic Waste Management Market) And Will Not Contain Waste Imported From Abroad. The Waste Will Come From: 1) Primarily From Producers Of Construction And Demolition Waste Who Commission The Ordering Party To Segregate Construction And Demolition Waste Off The Construction Site . In Such A Case, The Responsibility For The Implementation Of The Obligation To Segregate (Sort) Waste Assumed By The Ordering Party Will Also Be Transferred To The Contractor, Who Will Process (Sort) The Delivered Waste In Accordance With The Waste Processing Permit Held And Will Ensure The Management Of Waste Fractions Resulting From Sorting In Accordance With The Provisions Of Section 3. The Contractor Will Be Obliged, No Later Than On The Date Of Entry Into Force Of The Contract, To Have An Appropriate Decision/Decisions, The Provisions Of Which Will Indicate The Legal Possibility Of Fulfilling This Obligation In Accordance With The Provisions Of Art. 101A Of The Waste Act In The Version In Force From January 1, 2025; 2) From Producers Who Carry Out Their Own Selection Of Construction And Demolition Waste At The Construction Site.
