The Subject Of The Order Is The Purchase For The Needs Of The Agency For Restructuring And Modernization Of Agriculture (Hereinafter Referred To As The Ordering Party) Of Brand New, Without Traces Of Use Or Damage, 14 Computer Servers (Hereinafter Referred To As It Equipment) With Management And Diagnostic Software (Hereinafter Referred To As : Software), Support And Warranty Service For A Period Of 36 Months, Meeting At Least The Parameters And Functionalities Described In Annex 1 To The Draft Provisions Of The Contract (Hereinafter: Ppu) Together With The Annexes Constituting Annex No. 7 To The Specification Of Terms Of Contract (Hereinafter: Swz). 2. The Ordering Party Requires The Delivery Of 14 Servers (Datacenter) Of Three Types (Dba - 4 Pieces, Dbb - 2 Pieces, Dca - 8 Pieces), Which Will Operate In The Ordering Partys Two Basic Data Processing Centers - Located In Warsaw And Piaseczno Indicated In The List Of Locations Included In Annex No. 3 To The Ppu. 3. The Contractor Will Deliver, Install, Configure And Launch It Equipment With Software In Accordance With The Specifications And Ensuring At Least The Functionalities Referred To In Annex 1 To The Ppu, Including: 3.1 Will Provide The Ordering Party - On The Terms Specified In The Ppu And General License Conditions Software Manufacturer - The Right To Use (Under License) The Software, Including Both The Entire Software And Its Individual Elements, Along With The Right To Use The Documentation Of The It Equipment Manufacturer And Software (Technical, User, Administrator); 3.2 Will Provide The Ordering Party With The Right To Unlimited Use Of The Software And Its Documentation In Accordance With Point 4.1 On A License Basis, Starting From The Date The Ordering Party Signs The Implementation Protocol Without Any Reservations, Including Providing A License Document Issued By The Manufacturer Of The It Equipment And Software Confirming The Right To Use By The Ordering Party From The Software, In Accordance With The Provisions Of The Contract And The Manufacturers General License Conditions And Prepared In Polish (Or In English, If There Is No Polish Language Version) The Content Of The Manufacturers License Terms And General Conditions Of Use Of The Software; 3.3 Will Perform And Carry Out The Implementation In Accordance With The Provisions Of § 5 Section 6 Ppu; 3.4 Will Provide Instruction To Persons Indicated By The Ordering Party, In Accordance With The Terms Of The Ipc. 4. The Contractor Will Provide The Ordering Party With Warranty Service For It Equipment And Software For A Period Of 36 Months From The Date Of Signing The Implementation Protocol Without Any Reservations By The Ordering Party, Including The Provision Of Manufacturer Support (Service Support) By Issuing An Appropriate Document To The Ordering Party Confirming The Right To Access Support. Manufacturer In The Above-Mentioned Period, In Accordance With The Manufacturers General Conditions. 5.
