The Subject Of The Order Is Comprehensive Supply Of Natural Gas Group E (High-Methane) To The District Court In Milicz, The District Court In Strzelin And The District Court In Wołów, Including The Sale And Provision Of Distribution Services Of High-Methane Natural Gas, With A Total Maximum Forecast Volume Of 450,716 Kwh (Basic Order) Up To 4 Gas Collection Points (Po). The Projected Consumption Of Natural Gas Indicated Above Is Indicative And May Differ From The Actual Amount Of Gas Consumed During The Contract Period. Reducing Or Increasing The Amount Of Gas Will Not Result In Any Consequences For The Ordering Party, Apart From The Need To Pay For The Actually Consumed Amount Of Gas And Transmission Services In Accordance With The Applicable Operators Tariff, On The Terms Specified In Point 3.2. The Ordering Party, Exercising The Option Right, Reserves The Right To Limit By 15% The Maximum Size Of The Subject Of The Order - I.E. The Maximum Quantity Of Ordered Gas Fuel Indicated In § 4 Section 8 Of The Contract Template (Annex No. 3 To The Swz), And As A Result Of All The Related Parameters Of Gas Fuel Supplies Indicated In Annex No. 2 To The Agreement - Detailed Description Of The Subject Of The Order, In Such A Way That May Result In A Reduction Of The Maximum Value Of The Contract By No More Than 15%. Failure By The Ordering Party To Perform The Contract In The Scope Of The Remaining 15% Of The Maximum Value Of The Subject Of The Order Does Not Require Giving Reasons And Does Not Constitute The Basis For Its Liability For Non-Performance Or Improper Performance Of The Contract, And The Contractor Is Not Entitled To Any Claims In This Respect.
