If The Entire Amount Specified In The Contract Is Not Used Due To A Reduction In Demand, The Contractor Will Receive Remuneration For The Actual Amount Of Work Performed, Determined On The Basis Of The Unit Rate And The Actual Amount Of Work Performed. The Contractor Will Perform All Necessary Work For The Proper Execution Of The Subject Of The Order. The Work Should Be Performed In Accordance With The Tender Documentation And In Consultation With The Ordering Party. Work Execution Technology: Work Related To The Implementation Of The Investment Should Be Carried Out In Accordance With Applicable Standards, Construction Law Provisions, Legal Provisions Regarding Technical Requirements, Environmental Protection, Occupational Health And Safety Rules And Technical Knowledge .The Contractor, On His Own Responsibility And At His Own Expense, Must Take All Preventive Measures Required By Sound Construction Practice And Current Circumstances To Protect The Rights Of Owners Of Properties Adjacent To The Construction/Works Site And To Avoid Causing Any Disruptions Or Damage There. The Contractor Is Liable For Any Damage Resulting From The Implementation Of The Subject Of The Contract In Relation To Third Parties. The Surrounding Area And Pedestrian And Vehicular Traffic Should Be Permanently Protected Against The Impact Of The Works. Social Clause: The Ordering Party Requires That Persons Performing Services And Construction Works Specified In The Tender Documentation And Equipment Operators Were Employed Under An Employment Contract By The Contractor Or Subcontractor, With The Exception Of Persons Whose Duties Do Not Consist In Performing Works In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws 2022.1510, Consolidated Text Of 2022/07/19), Which May Apply, Among Others, To Construction Managers And Managers Of Industrial Works. Each Time At The Request Of The Ordering Party, Within The Period Specified By The Ordering Party, Not Shorter Than 5 Business Days, The Contractor Undertakes To Submit For Inspection Copies Of Employment Contracts Concluded By The Contractor With Employees Providing Services/Construction Works. Failure Of The Contractor To Submit Copies Of Contracts Concluded By The Contractor With Employees Providing Services /Construction Works Within The Deadline Specified By The Ordering Party In Accordance With Point 2 Will Be Treated As Failure To Fulfill The Obligation To Employ Employees Providing Services/Construction Works Under An Employment Contract.
