Training Services – Organizing And Conducting Two-Day Seminars For Educational Staff In The Field Of Inclusive Education As Part Of The Regional Support For Inclusive Education Project. 1. The Subject Of The Order Is To Organize And Conduct Five Cycles Of Three Two-Day Seminars (A Total Of 15 Seminars Covering 2 Days And 1 Night) For A Maximum Of 750 Participants (Maximum 50 Participants Per One Seminar). A Detailed Description Of The Subject Of The Order Is Specified In Annex No. 1 To The Swz And In The Contract Template Constituting Annex No. 2 To The Swz. 2. If There Is A Need To Increase The Number Of Seminars, The Ordering Party Envisages The Use Of The Option Right Referred To In Art. 441 Of The Public Procurement Law. The Option Assumes Increasing The Subject Of The Order By A Maximum Of 15 Seminars (Including 2 Days And 1 Overnight Stay), While Maintaining The Gross Unit Price Per Person Indicated For The Basic Order, Taking Into Account That The Option Will Be Exercised By October 31, 2026. Details Regarding The Option Right Are Described In The Swz. 3. The Law Applicable To This Order (Including The Contract Concluded As A Result Of These Proceedings And For The Assessment Of The Legal Effects Of All Documents In This Order) Is Polish Law, Taking Into Account European Union Law. 4. In All Provisions Of The Swz And Its Annexes In Which The Ordering Party Refers To Standards, Approvals, Technical Specifications Or Reference Systems Or Indicates Trademarks, Parameters Or Sources Of Origin (Names Of Manufacturers Or Devices), In Accordance With Art. 99 Section 5 And Art. 101 Section 4 Of The Public Procurement Law, The Ordering Party Allows Equivalent Solutions. 5. If The Description Of The Subject Of The Order Includes The Names Of Materials And Products Of Specific Manufacturers, This Should Be Treated Only As A Definition Of The Desired Standard And Quality. In All Such Situations, The Contractor May Offer Equivalent Materials And Products With At Least The Same Technical And Quality Parameters. Product Equivalence Means Offering A Product Whose Technical Parameters Of The Materials Used, Efficiency, Durability And Quality Are Not Inferior To The Quality Of The Materials And Products Described In The Swz. 6. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Their Description Or Standards. 7. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Parts Of The Order. The Contractor May Entrust The Execution Of Part Of The Order To A Subcontractor. 8. Subcontracting: 1) The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S). 2) In Connection With The Execution Of The Order, The Ordering Party Does Not Reserve The Obligation To Personally Perform Key Tasks Of The Order. 3) The Ordering Party Requires That In The Event Of Entrusting Part Of The Contract To Subcontractors, The Contractor Must Indicate In The Offer The Parts Of The Contract The Performance Of Which It Intends To Entrust To Subcontractors And Provide (If They Are Already Known) The Names Of These Subcontractors. 4) Entrusting Parts To Subcontractors Does Not Exempt You
