The Subject Of The Order Titled: Current Road Maintenance (Breakthroughs) In The Czechowice-Dziedzice Commune Includes, Among Others: Partial Renovation Of Mineral-Bituminous Surfaces Or Filling Of A Breakthrough In A Surface Improved With A Mineral-Bituminous Mixture With Asphalt Binder, Milling Of The Mineral-Bituminous Surface , Demolition Of Various Road Surfaces And Sidewalks Or Their Relocation, Vertical Adjustment Of Sewer Manholes And Grates Street Sewage, Adjustment Of Water And Gas Valves, Vertical Adjustment Of Telephone Manholes, Reinforcement Of Existing Base Layers With Crushed Stone Or A Mineral-Bituminous Mixture, Surface Consolidation Of The Surface With Asphalt Emulsion With Stone Grit, Removal Of Waste Generated During The Work And Its Disposal. Detailed Description The Subject Of The Order Include Annexes To The Swz, I.E.: - Detailed Technical Specification (Sst) - Annex No. 10 To The Swz; - Bill Of Quantities - Annex No. 11 To The Swz; - Draft Provisions Of The Contract - Annex No. 12 To The Swz; Which Constitute An Integral Part Of The Specification Of The Terms Of The Contract.1.1. Law Of Option.1.1.1. As Part Of The Subject Of The Order, The Ordering Party Envisages The Use Of The Option Right - Conditions For Exercising The Option Right: A) The Use Of The Optional Order Will Depend On The Current Needs Of The Ordering Party As An Entitlement Which It May, But Does Not Have To Use, B) The Ordering Party Has The Right To Exercise The Option Right During Duration Of The Contract, This Right Is One-Time, C) The Contractor Is Obliged To Execute The Order Provided For By The Option Law On The Terms Described In The Swz, D) The Ordering Party Will Inform The Contractor Of The Intention To Exercise The Option Right To A Specified Extent. The Lack Of Appropriate Information Means That The Optional Order Has Been Canceled In Whole Or In Part (If The Ordering Party Has Partially Used The Optional Orders), E) Orders Implemented Under The Options Are A Unilateral Right Of The Ordering Party. Failure To Place Orders Covered By The Option Does Not Give Rise To Any Claims On The Part Of The Contractor Against The Ordering Party.1.1.2. The Scope Of Works Given In The Bill Of Quantities - Annex No. 11 To The Swz - Concerns The Planned Number Of Current Renovations Of Mineral And Bituminous Surfaces (Breakthroughs). The Ordering Party Is Not Obliged To Carry Out The Planned Number Of Ongoing Renovations Of Mineral And Bituminous Surfaces (Breakthroughs). The Actual Number Of Ongoing Renovations Of Mineral-Bituminous Surfaces (Breakthroughs) May Differ From The Planned Amounts. The Ordering Party Has The Right To Reduce Or Increase The Scope To 50% Of The Amount Resulting From The Bill Of Quantities In Accordance With The Option Law. 2.
