Refuse And Waste Related Services – Collection And Transport Of Municipal Waste From Property Owners Living In The City And Commune Of Nowa Sarzyna. 1. The Subject Of The Order Is The Collection And Transport Of Municipal Waste From Owners Of Real Estate Residing In The City And Commune Of Nowa Sarzyna In The Period From January 1, 2025 To December 31, 2025. 2. The Subject Of The Order Includes: 1) Collection Of Municipal Waste From Owners Of Real Estate Residing In From The City And Commune Of Nowa Sarzyna; 2) Transport Of Waste Referred To In Point 1 To The Sorting Plant For Mixed And Selective Waste, Composting Plant In Sigiełki, 37-418 Krzeszów; 3) Establishing And Running A Municipal Waste Selective Collection Point. 3. The Contractor Is Obliged To Comply With The Legal Provisions In Force During The Term Of The Contract, In Particular: 1) The Act Of December 14, 2012 On Waste (Journal Of Laws Of 2023, Item 1587, As Amended), 2 ) Act Of September 13, 1996 On Maintaining Cleanliness And Order In Municipalities (Journal Of Laws Of 2024, Item 399), 3) The Act Of January 11, 2018 On Electromobility And Alternative Fuels (Journal Of Laws Of 2024, Item 1289), 4) The Regulation Of The Minister Of The Environment Of January 11, 2013 On Detailed Requirements For Collecting Municipal Waste From Property Owners (Journal Of Laws Of 2013, Item 122), 5) Regulation Of The Minister Climate And Environment Of August 3, 2021 On The Method Of Calculating The Levels Of Preparation For Re-Use And Recycling Of Municipal Waste (Journal Of Laws Of 2021, Item 1530), 6) Regulation Of The Minister Of The Environment Of December 15, 2017 In On The Levels Of Limitation Of Landfilling The Mass Of Biodegradable Municipal Waste (Journal Of Laws Laws Of 2017, Item 2412), 7) Regulation Of The Minister Of Climate And Environment Of May 10, 2021 On The Method Of Selective Collection Of Selected Waste Fractions (Journal Of Laws Of 2021, Item 906). 4. Reasons For Not Dividing The Contract Into Lots: Ordering Party Does Not Provide For The Division Of The Contract Into Parts, Because The Subject Of The Contract - Collection And Transport Of Municipal Waste - Is Of A Homogeneous Nature And Covers The Provision Of The Same Type Of Services. Dividing The Order Into Parts, In The Case Of Homogeneous Services, Would Lead To An Increase In The Costs Of Providing The Service And Would Make Its Coordination More Difficult. Execution Of The Order By One Contractor Ensures Better Efficiency In Service Management And Supervision Of Its Implementation, Especially In The Context Of Environmental Protection Regulations That Regulate Waste Management. Moreover, Dividing The Order Into Parts Would Involve The Risk Of Differences In The Prices Of Services Provided In Individual Parts, Which Could Lead To Unjustified Social Protests Related To The Rates Of Fees For Municipal Waste Management.
