The Subject Of The Order Is The Purchase Of Electricity Within The Meaning Of The Act Of April 10, 1997, Energy Law (Journal Of Laws Of 2024, Item 266, As Amended) For The Niżański District And Its Organizational Units Specified In Annex No. 5 To The Swz. At The Same Time, The Ordering Party Indicates That: 1) Electricity Is Sold Through The Distribution Network Belonging To The Distribution System Operator (Osd), I.E. Pge Dystrybucja S.A. The Conditions For The Provision Of Distribution Services Are Specified In A Separate Agreement With The Dso.2) The Sale Of Electricity Will Take Place On The Terms Specified In The Provisions Of The Act Of April 10, 1997 - Energy Law (Journal Of Laws Of 2024, Item 266, As Amended). And In Accordance With The Implementing Regulations Issued For This Act, In Particular With The Customer Service Standards Specified In The Regulation Of The Minister Of Climate And Environment Of November 29 2022 On The Method Of Shaping And Calculating Tariffs And The Method Of Settlement In Electricity Trade (Journal Of Laws Of 2024, Item 904).3) Estimated Annual Energy Demand - The Estimated Total Amount Of Energy Per Year Is Approx. 328,290 Kwh Including Tariff C11 – 288,259 Kwh, G11 – 39,112 Kwh, C12b - 919 Kwh.4) The Estimated Amount Of Energy Provided Is Indicative, Used To Determine The Value Of The Order And Compare Offers And Does Not Constitute An Obligation On The Part Of The Ordering Party To Purchase Electricity In The Given Amount. The Contractor Will Not Be Entitled To Any Claim For The Ordering Partys Consumption Of Energy Other Than The Expected Amount. The Quantity Specified Above May Change At The Stage Of Order Execution, Depending On Actual Consumption.5) The Ordering Party Reserves The Right To Change The Scope Of The Subject Of The Order In Relation To The Consumption Points Indicated In Annex No. 5 To The Swz In The Case Of, Among Others: Sale, Purchase, Exchange, Rental, Lease Of Real Estate Or Accession Of Other Organizational Units Of Niżański County In Which Metering Systems Are Located And Tariff Changes Within The Tariff Groups Indicated In The Swz And Priced By The Contractor In The Offer Form During The Term Of The Contract.6) As Part Of Concluded Sales Contract And Without Additional Remuneration, The Contractor Will Be Responsible For Commercial Balancing. The Contractor Will Release The Ordering Party From All Costs And Obligations Related To Imbalance.7) The Ordering Party Has Legal Titles To All Objects Specified In Annex 5 To The Swz. Equivalence Of Materials And Equipment - If The Ordering Party Has Described The Subject Of The Order By Indicating The Names Of The Products Or The Manufacturer, Trademarks Or Origin, It Should Be Understood That Equivalent Solutions May Be Used. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Products He Offers Meet The Requirements Specified By The Ordering Party By Attaching A Description Of The Equivalent Product/Subject
