1. Characteristics1.1. The Subject Of The Order Is: A) Supply Of Electricity, Including The Sale Of Electricity To The Facilities Of Solpark Kleszczów Sp. Z O. O. In Kleszczów. At Ul. Sportowa 8 And The Solpark Hotel At Ul. Sportowa 3, On The Terms Specified In The Energy Law Act Of April 10, 1997 And On The Implementing Acts Issued On Its Basis, B) Settlement Of Surplus Electricity Generated In The High-Efficiency Cogeneration And Photovoltaic Installation, Which Was Introduced Into The Network Of The Local Dso, Together With The Service Commercial Balancing On The Terms Specified In The Draft Contract, Constituting Annex No. 5 To The Swz Of The Proceedings In Question. C) The Contractor Will Provide The Necessary Volume Of Electricity At A Price Calculated/Determined In Accordance With The Provisions Of § 6 Of The Contract Template (Appendix No. 5 To The Swz).1.2 . The Detailed Description Of The Subject Of The Order (Hereinafter Referred To As Opz) Is Attached As Annex No. 7 To Swz1.3. The Contractor Also Undertakes To Act As The Entity Responsible For Commercial Balancing For Electricity Produced And Fed Into The Dso Network.1.4. Costs Resulting From Balancing Should Be Included By The Contractor In The Price Of Electricity Given In The Price Form.1.5. The Settlement Of The Delivery And Service Will Be Based On The Actual Energy Consumption According To The Prices And Fee Rates Resulting From The Submitted Offer.1.6. The Supply Of Electricity Will Take Place Under The Conditions Specified In The Provisions Of The Act Of April 10, 1997, Energy Law (Journal Of Laws Of 2024, Items 266, 834, 859) And The Implementing Acts Issued On Its Basis.1.7. Electricity Should Meet Technical Parameters In Accordance With The Provisions Of The Energy Law And The Implementing Regulations To This Act And Polish Standards.1.8. The Estimated Amount Of Energy Ordered Is Indicative, Used To Compare Offers And In No Case Constitutes An Obligation On The Part Of The Ordering Party To Purchase Energy In The Given Amount. The Contractor Will Not Be Entitled To Any Claim For Failure To Collect The Expected Maximum Amount Of Energy Of 1,087,837Kwh By The Ordering Party.1.9. The Subject Of The Order Does Not Include Distribution Services.1.10. Electricity Will Be Sold To Consumption Points Via Distribution Networks Belonging To The Local Distribution System Operator.1.11. The Ordering Party Has Concluded A Contract For The Provision Of Electricity Distribution Services With The Distribution System Operator (Dso), Which For The Ordering Party Is Energoserwis Kleszczów Sp. Z O. O. The Contractor, On The Basis Of The Power Of Attorney Granted By The Ordering Party, Is Obliged To Submit To The Dso, On Behalf Of The Ordering Party, A Notification On Concluding A Contract For The Sale Of Electricity.1.12.
