Electricity, Heating, Solar And Nuclear Energy – Purchase Of Electricity For The Needs Of The Polish Academy Of Sciences And Its Organizational Units. 1. The Order Concerns The Purchase Of Active Electricity Available On The Market That Meets The Quality Standards Specified In The Provisions Of The Act Of April 10, 1997, Energy Law (Consolidated Text: Journal Of Laws Of 2024, Item 266, As Amended), Hereinafter Referred To As The Law. Energy, In A Total Estimated Amount Of 2,634.155 Mwh, For 55 Energy Consumption Points Of The Ordering Party Specified In The Annexes To This Specification, Divided Into Tariff Groups. The Ordering Party Declares That It Is An End User Within The Meaning Of The Energy Law, Which Means That The Electricity Purchased From The Contractor Is Intended Solely For Its Own Needs Unrelated To The Activities Of Electricity Trading Or Electricity Distribution. 2. The Ordering Party Reserves The Right To Change The Amount Of Energy Actually Delivered During The Term Of The Contract In Terms Of The Forecast Volume Of Energy [Mwh] In Individual Tariff Groups Specified In The Offer Form Constituting Annex No. 2 To The Swz. Any Change In The Estimated Energy Consumption By The Ordering Party Will Not Result In Additional Costs On The Part Of The Contractor, Which The Entitled Person Will Claim From The Ordering Party, Apart From The Settlement For The Actual Amount Of Electricity Consumed According To The Unit Prices Specified By The Contractor In The Offer Form. For This Reason, The Contractor Will Not Have Any Additional Claims Against The Ordering Party Apart From The Remuneration Specified In The Contract. The Ordering Party Indicates That The Reduction In The Amount Of Actual Electricity Consumption Cannot Be Greater Than 20% Of The Planned Consumption. 3. The Ordering Party Reserves The Right To Reduce Or Increase The Number Of Electricity Consumption Points (Ppe). In The Event Of An Increase In The Number Of Ppe, The Settlement Of Additional Points Will Take Place Taking Into Account Net Unit Prices In Individual Tariff Groups, In Accordance With The Offer Form, Constituting Annex No. 2 To The Swz, With The Proviso That The Total Value Of The Contract Will Not Exceed The Amount Specified In §6 Section 1 Of The Contract Template. 4. For All Ppes, This Is Another Change Of Supplier And The Ordering Party Has Concluded Electricity Distribution Agreements For An Indefinite Period, Subject To Ppes For Which This Will Be The First Change Of Supplier, Indicated In Annex No. 1.1 To The Description Of The Subject Of The Order. 5. In Order To Implement The Subject Of The Order, The Contractor Must Have A Valid Contract Concluded, I.E. The So-Called General Distribution Agreement With The Local Distribution System Operator, Hereinafter Referred To As The Dso, Under Which It May Sell Electricity Through The Distribution Network Of This Dso To All Indicated Facilities Covered By The Proceedings. 6. In Order To Start Selling Energy At Each Energy Consumption Point, The Following Contracts Must Be In Force At The Same Time: 1) Agreement On The Provision Of Distribution Services Concluded Between The Ordering Party And The Relevant Dso; 2) General Distribution Agreement Concluded Between The Contractor And The Relevant Dso. 7.
