The Subject Of The Order Is The Delivery Of 8 Coffee Machines For Retrofitting Social Rooms At The Police Training Center In Legionowo And Sułkowice As Part Of The Basic Order And 2 Coffee Machines As Part Of The Option Right.2. The Ordering Party Provides For The Possibility Of Exercising The Option Right Referred To In Art. 441 Of The Act. The Option Right Can Only Be Used After 100% Of The Value Of The Basic Order (8 Coffee Machines) Has Been Completed, If There Are Financial Resources And The Need To Order A Larger Amount Of Equipment Than That Provided For In The Basic Scope. The Value Of An Order Awarded Under The Option Right Depends On The Financial Resources Available. 3. The Ordering Party Provides For The Possibility Of Exercising The Option Right To The Extent Indicated In The Order Documents, At The Prices Specified In The Offer, Subject To The Provisions Of The Draft Contract, Constituting Annex No. 5 To The Swz.4. The Ordering Party Reserves That The Order Defined As An Option Right Is An Entitlement And Not An Obligation Of The Ordering Party. The Option May Or May Not Be Exercised, Depending On The Financial Capabilities Of The Ordering Party. Failure To Complete The Order In This Respect Will Not Result In Any Claims From The Contractor.5. The Ordering Party Will Notify The Contractor In Writing About The Activation Of The Option Right No Later Than 3 Business Days Before The Date Of Completion Of The Basic Contract Implementation.6. If The Option Right Is Exercised, Settlement Will Take Place On The Terms Set Out In The Concluded Contract.7. The Ordering Party Does Not Allow The Submission Of Partial Offers.8. A Detailed Description Of The Subject Of The Contract Is Specified In The Swz Part Description Of The Subject Of The Contract Constituting Annex No. 4 To The Swz.9. The Ordering Party Does Not Allow The Submission Of Variant Offers.10. The Ordering Party Does Not Allow Entrusting The Execution Of Part Of The Order To A Subcontractor.11. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Essential Provisions Of The Contract, Constituting Annex No. 5 To Swz.12. Pursuant To Art. 310 Of The Act, The Ordering Party May Invalidate The Contract Award Procedure If The Public Funds That The Ordering Party Intended To Use To Finance The Contract Were Not Awarded To It.13. The Ordering Party Reserves That The Total Value Of The Order May Not Exceed Its Financial Resources.14. The Subject Of The Order As Part Of The Basic Order Together With The Option Will Be Delivered At The Expense Of The Contractor, Who Will Unload It At The Place Indicated By The Ordering Party By December 10, 202415. The Subject Of The Order Will Be Delivered Once To The Ordering Partys Office On Business Days From 8:00 A.M. To 2:00 P.M., After Prior Arrangement With The Ordering Partys Coordinator.16. The Contractor Will Notify The Ordering Partys Coordinator In Writing About The Delivery Date No Later Than 24 Hours
